Common use of Acting Status Clause in Contracts

Acting Status. 60:01 Where the Employer directs an employee employed in one position to temporarily take over the duties and responsibilities of some other position having a higher grade of pay, and provided the employee takes over and continues to perform for five (5) or more consecutive working days the duties and responsibilities of that other position, the employee shall be appointed temporarily to that other position with acting status and shall be paid at the rate of pay for that other position from the date of taking over the duties and responsibilities of that other position until the temporary appointment is revoked; and upon the temporary appointment being revoked shall, unless the employee is appointed or promoted to some other position, revert to his or her original position and be paid at the rate of pay for his or her original position that the employee would be paid if the employee had never held the temporary appointment.

Acting Status. 60:01 26:01 Where the Employer an Authority representative or designate directs an employee employed in one (1) position to temporarily take over the duties and responsibilities of some other position having a higher grade of pay, and provided the employee takes over and continues to perform for five ten (510) or more consecutive working days the duties and responsibilities of that other position, the employee shall be appointed temporarily to that other position with acting status and shall be paid at the rate of pay for that other position from the date of taking over the duties and responsibilities of that other position until the temporary appointment is revoked; and upon the temporary appointment being revoked the employee shall, unless the employee is appointed or promoted to some other position, revert to his or her the employee’s original position and be paid at the rate of pay for his or her the employee’s original position that the employee would be paid if the employee had never held the temporary appointment.

Acting Status. 60:01 16:01 Where the Employer or designate directs an employee employed in one position to temporarily take over the duties and responsibilities of some other position having a higher grade of pay, and provided the employee takes over and continues to perform for five eleven (511) or more consecutive working days the full duties and responsibilities of that other position, the employee shall be appointed temporarily to that other position with acting status and shall be paid at the rate of pay for that other position from the date of taking over the duties and responsibilities of that other position until the temporary appointment is revoked; and upon the temporary appointment being revoked he or she shall, unless the employee is appointed or promoted to some other position, position revert to his or her original position and be paid at the rate of pay for his or her the original position that the employee he or she would be paid if the employee he or she had never held the temporary appointment.
