ACCEPTABLE USE OF SERVICES. Subject to Clarity’s service and maintenance responsibilities set forth in Section 2, Customer agrees to use the Services only for lawful purposes. Customer agrees not to use Clarity Services for transmitting or receiving any communication or material of any kind which in Clarity’s reasonable judgment the transmission, receipt or possession of such communication or material (i) would constitute criminal or illegal activities; give rise to a civil liability, or otherwise violate any applicable local, state, national or international law or (ii) encourages conduct that would constitute a criminal offense, give rise to a civil liability, or otherwise violate any applicable local, state, national or international law. Customer agrees not to attempt to hack, misuse, disrupt or disable or damage the Service in any way and that it will not interfere with or disrupt other users of Services and/or any other service provider who furnishes services to Customer in connection with this Agreement. Customer will not deliberately or intentionally fail to configure, operate or maintain any devices using Clarity’s services in accordance with industry standards and best practices, including the limitation of excessive “keep alives,” short registration timers, message flooding and other abusive activities. Customer agrees not to engage in the delivery of unwanted or unsolicited communications or SPAM to third parties using Clarity Services or resources. Clarity reserves the right to terminate your service upon 10 days’ notice if Clarity, in its reasonable discretion, believes that you have violated the above restrictions to its detriment, leaving you responsible for the full month's charges to the end of the current term, including without limitation unbilled charges and taxes, plus a termination fee not to exceed an amount equal to three times the monthly usage fee, all of which shall immediately become due and payable. If Clarity, in its reasonable discretion believes that you have violated the above restrictions, Clarity may forward the objectionable material, as well as your communications with Clarity and your personally identifiable information to the appropriate authorities for investigation and prosecution and you hereby consent to such forwarding.

ACCEPTABLE USE OF SERVICES. Subject The Services and EPB Equipment provided to Clarity’s service and maintenance responsibilities set forth in Section 2Customer shall only be used by the Customer for commercial, nonresidential use. Customer agrees shall not: (i) make the Services and/or EPB Equipment available, nor permit the Services and/or EPB Equipment to be made available to one or more third parties; (ii) resell or transfer the Services or EPB Equipment to any other person for any purpose, or charge others to use the Services only or EPB Equipment; (iii) use the Services in any manner that is contradictory to this Agreement or to EPB's Acceptable Use Policy; (iv) tamper with, disrupt, or "hack" the Services or EPB Equipment; (v) make use of the Services or EPB Equipment in any way that is inconsistent with their intended purpose. It is Customer’s responsibility to read and understand these Terms and Conditions and the applicable Genetec, Inc. agreements and terms which can be found at xxxxx://xxx.xxxxxxx.xxx/legal prior to accepting any Services and EPB Equipment. It is Customer’s sole responsibility for lawful purposesensuring that other users of the Services and EPB Equipment understand and comply with this Agreement and the applicable Genetec, Inc. agreements and terms which can be found at xxxxx://xxx.xxxxxxx.xxx/legal. UNAUTHORIZED USE OF THE SERVICE OR TAMPERING Customer agrees not to use Clarity Services for transmitting or receiving assist any communication other person to use any unauthorized equipment or material of any kind which in Claritydevice to access or tamper with EPB’s reasonable judgment fiber optic network, the transmission, receipt or possession of such communication or material (i) would constitute criminal or illegal activities; give rise to a civil liabilityServices, or otherwise violate EPB Equipment for any applicable localpurpose including, statebut not limited to, national the unauthorized use and reception of the Services. EPB may terminate the Services and seek damages from Customer if you perform any action described above. The unauthorized use, access or international law or (ii) encourages conduct that would constitute a criminal offensetampering of the EPB fiber optic network, give rise to a civil liabilityServices, or otherwise violate any applicable local, state, national EPB Equipment may result in criminal prosecution. SALES AGREEMENT A Sales Agreement must be completed to initiate Services or international lawfor EPB Equipment to be provided. Customer agrees not to attempt to hack, misuse, disrupt or disable or damage the Service in any way and that it will not interfere with or disrupt other users of A Customer’s request for Services and/or any other service provider who furnishes services EPB Equipment shall be signed and submitted by Customer to Customer in connection with this EPB on an EPB designated Sales Agreement. Customer will not deliberately or intentionally fail to configure, operate or maintain any devices using Clarity’s services in accordance with industry standards A Sales Agreement shall become binding when signed by the Customer. When a Sales Agreement becomes binding these EPB Hosted Camera Terms and best practices, including the limitation of excessive “keep alives,” short registration timers, message flooding and other abusive activities. Customer agrees not to engage in the delivery of unwanted or unsolicited communications or SPAM to third parties using Clarity Services or resources. If ClaritySIPSRUS, in its reasonable sole discretion believes that you have e violated the above restrictions, Clarity SIPSRUS may forward the objectionable material, as well as your communications with Clarity SIPSRUS and your personally identifiable information to the appropriate authorities for investigation and prosecution and you hereby consent to such forwarding. Customer agrees that the use of the Services for activities other than reasonable personal residential use will obligate Customer to pay SIPSRUS’s higher rates for business services for all periods of such use, including past periods, in which Customer used the Services for commercial or governmental purposes. SIPSRUS reserves the right to immediately terminate or modify the Services, if SIPSRUS determines, in its sole discretion that Customer’s use of the Services is for non-residential or commercial use.
