Xxxxx Litigation definition

Xxxxx Litigation means the pending lawsuit captioned Xxxxx v. CGA Investment Management, Inc., filed in the Supreme Court of the State of New York, County of New York.

Xxxxx Litigation means the lawsuit filed on December 10, 2010, entitled Christou, et al. v.

• The Settlement, this Settlement Agreement, and evidence thereof shall not be used, directly or indirectly, in any way, in the Rotstain Litigation, the SEC Action, the Xxxxx Litigation, or in any other proceeding, other than to enforce the terms and/or intent of the Settlement and this Settlement Agreement or to defend against or facilitate a dismissal of any other proceeding against Independent.

Xxxxx Litigation has the meaning ascribed to it in Clause 2.2.3.

Xxxxx Xxxxx, CV00-02018, filed in April 2000 in Department No. 4 of the Second Judicial District Court in Washoe County, Nevada, the default judgment entered by the court in connection therewith and any subsequent litigation initiated by Far West and SDC in other jurisdictions to domesticate and enforce such judgment.

Xxxxx Litigation means the Suit pending against Xxxx (and/or one or more of the Acquired Companies) by Xxxx Xxxxx (and certain of his family members) in the United States District Court for the Southern District of West Virginia in Parkersburg and any Suit (whether at law or in equity) or any proceeding resulting from any appeal, reversal, retrial or remand therefrom.

Xxxxx Litigation means the lawsuit entitled Xxxxx x. Xxxxxxxxxxxx, et al., C.A. No. 2018-0277-MTZ (Del. Ch. 2018) class and derivative action and any related actions.

Xxxxx Litigation means the legal proceeding captioned XXXXX V. ADVANCED ACCESSORY SYSTEMS, LLC, pending on appeal in the United States Court of Appeals for the Sixth Circuit, Docket No. 01-1740, from the matter captioned XXXXX V. ADVANCED ACCESSORY SYSTEMS, LLC in the United States District Court for the Eastern District of Michigan, Case Nos. 96-cv-71458 and 96-cv-73954 and any cause of action, suit, demand or claim (whether at law or in equity) or any proceeding resulting from a remand or reversal thereof or appeal therefrom.
