Examples of Unforeseeable Emergency Withdrawal in a sentence
To the extent elected by the Employer in the Adoption Agreement, the ability to apply for an Unforeseeable Emergency Withdrawal may be restricted to Participants whose Termination Date has not yet occurred.
If elected by the Employer in the Adoption Agreement, if a Participant or Beneficiary incurs a severe financial hardship of the type described below, he may request an Unforeseeable Emergency Withdrawal, provided that the withdrawal is necessary in light of severe financial needs of the Participant or Beneficiary.
Notwithstanding the foregoing, if the Employer has elected in the Adoption Agreement to permit Unforeseeable Emergency Withdrawals pursuant to subsection 9.8, the Participant’s Deferrals under this Plan shall cease as soon as administratively feasible upon approval by the Administrator of a Participant’s properly submitted request for an Unforeseeable Emergency Withdrawal under subsection 9.8.

An Unforeseeable Emergency Withdrawal will have no effect on the timing of the distributions of any amounts remaining in such Participant’s Account, and, except as otherwise determined by the Committee or its delegate pursuant to Section 3.3, will not have any effect on any current or future Deferral Election after the Unforeseeable Emergency Withdrawal.
A distribution request (also referred to herein as a claim) shall be made by filing a written request with the Administrative Committee on a form provided by the Administrative Committee, which shall be delivered to the Administrative Committee and, in the case of a request for a Unforeseeable Emergency Withdrawal, be accompanied by such substantiation of the claim as the Administrative Committee considers necessary and reasonable.
The amount of any Unforeseeable Emergency Withdrawal shall not exceed the amount determined by the Administrative Committee to be necessary to alleviate such Unforeseeable Emergency, including any taxes payable by the Participant as a result of receiving such Unforeseeable Emergency Withdrawal.
In the case of a Unforeseeable Emergency Withdrawal, in a single sum as soon as administratively possible following its approval by the Administrative Committee, with the Participant’s Account being valued as of the date on which the Unforeseeable Emergency Withdrawal is approved, or if such date is not a Business Day, on the Business Day first occurring after the date of approval.
