Test Field definition

Test Field means the development, use and commercialization of Tests.

  • If Merck does not Trigger the Test Exclusivity License in accordance with Section 3.1.3(c)(i), then, effective as of the first day after the expiration of the Option Period, Merck hereby grants to FHT a non-exclusive, royalty-free, sublicensable license in the Territory under Merck Collaboration Program Patents, and to use Merck Collaboration Program Inventions and Results, in the Test Field.
