Subsequent User definition

Subsequent User means any other user of the Tower that submits to BellSouth a site application for the use of such Tower after the submission of User's Site Application for such Tower. In the event BellSouth determines, in its sole discretion based on standard and accepted engineering practices, that the Subsequent User is interfering with the operation of User's equipment, authorized frequency spectrum, signal strength or Facilities, BellSouth shall, within forty-eight (48) hours of notification, take all steps reasonably necessary to eliminate the interference, with the exception of ceasing the Subsequent User's operations. If the Subsequent User cannot eliminate or resolve such interference within the forty-eight (48) hour period, BellSouth shall take all steps reasonably necessary to require that the Subsequent User turn off its facilities and only turn on its facilities during off-peak hours specified by BellSouth in order to test whether such interference continues or it has been satisfactorily eliminated. In the event that the Subsequent User is unable to resolve or eliminate, to the satisfaction of BellSouth, such interference within thirty (30) days from the initial notification of such interference, the Subsequent User will immediately remove or cease operations of the objectionable facilities. Notwithstanding the foregoing, if the Subsequent User is a governmental entity, BellSouth shall have the right to give the governmental entity five (5) business days notice prior to BellSouth being required to take any actions required by this Section 14(e) to cure such interference. BellSouth shall give such governmental entity written notice of the interference within two (2) business days of BellSouth's determination that such action is reasonably necessary. BellSouth's notice to the governmental entity shall be deemed given on the day it is delivered by hand or on the day it is deposited with an overnight courier or the United States mail;
Subsequent User means a third party to whom a holder of an access permit transfers biological or genetic resources or associated traditional knowledge; and
Subsequent User. Any user of the Site which submits its Site Engineering Application to Licensor for that Site after the submission of Licensee's Site Engineering Application, or any Prior User which materially modifies its use of the Site, including, without limitation, any change to frequency channel or range, antenna height, output power or effective radiated power, or relocation of the transmission equipment at the Site.

  • Upon the request of Licensee, Licensor hereby covenants to take commercially reasonable efforts to prohibit a Subsequent User from causing Interference with the operations of Licensee to the extent Licensee is a Priority User pursuant this section 11.

  • Notwithstanding the foregoing, if the Subsequent User is a governmental entity, BellSouth shall have the right to give the governmental entity five (5) business days notice prior to BellSouth being required to take any actions required by this Section 14(e) to cure such interference.

Subsequent User means (i) with respect to installation of specific Authorized Equipment located on a Site, any other User of a Site that submits to Owner a notice of intent to lease for Equipment on such Site after (A) with respect to Indosat Sites leased pursuant to Article III, installation of such specific Authorized Equipment on Site Space on such Indosat Site, or (B) with respect to Site Space leased on any Site pursuant to Article IV, submission of Indosat's Notice of Intent to Lease for the installation of such specific Authorized Equipment on Site Space on such Site, and (ii) with respect to any modification, replacement, relocation or addition of specific Authorized Equipment installed on a Site by Indosat, any other User that has submitted to Owner a notice of intent to lease which serves as the basis for a tower lease agreement for Equipment on such Site by such other User, after Indosat's submission of a Notice of Intent to Lease or Equipment Installation Plan with respect to such specific modification, replacement, relocation or addition of Authorized Equipment.
Subsequent User has the meaning given to it in the Act; “Tax” includes: all taxes levied, imposed or assessed under the Income Tax Assessment ▇▇▇ ▇▇▇▇ (Cth) and the Income Tax Assessment ▇▇▇ ▇▇▇▇ (Cth) or any other statute, ordinance or law in Australia or elsewhere; taxes in the nature of sales tax, consumption tax, value added tax, payroll tax, group tax, PAYE, PAYG, undistributed profits, fringe benefits tax, recoupment tax, withholding tax, land tax, water rates, municipal rates, stamp duties, gift duties or other state, territorial, Commonwealth of Australia or municipal charges or impositions levied, imposed or collected by any governmental body; and together with any additional tax, interest, penalty, charge, fee or other amount of any kind assessed, charged or imposed in relation to the late or short payment of the same or the failure to file any return.
Subsequent User. Any other user of a Site which installs its equipment after the date on which User or UOC installed the Equipment at the same Site.
