Software Copies definition

Software Copies means the actual copies of all and any portion of the Software, including backups, updates, merged or partial copies permitted hereunder or supplied to Licensee by ▇▇▇▇▇▇▇ Systems.
Software Copies means an object code copy of any of the Software, together with the copy or copies of any user manual or other documentation necessary for distribution and use of the Software.
Software Copies means an object code (machine-readable) copy or copies of the LA Software, together with a copy or copies of any accompanying Documentation relating thereto that is designated by LA for distribution to End-Users, along with all related materials required by LA for distribution of finished goods, including without limitation, duplication media, envelopes, labels, and packaging. All such copies shall be fixed on CD- ROM, diskette or other tangible media, except as expressly permitted in Section 7(a) below.

Examples of Software Copies in a sentence

  • In the event that VERITAS is not able to achieve (i) or (ii) above, VERITAS shall refund to IMG all payments made by IMG hereunder with respect to affected Software Copies.

  • IMG will be entitled to reproduce its own Software Copies, and/or to obtain Software Copies from VERITAS as set forth in Section 7 below for Software Products for which VERITAS offers Media Kits.

  • All Software Product End User licenses, and IMG's and its Affiliates' right to use, as End Users, Software Copies existing as of the effective date of termination or expiration, shall survive perpetually.

  • After termination or expiration, IMG shall be entitled to retain and use a reasonable number of Software Copies, and Documentation, for support and maintenance purposes.

  • You may not rent, lease, lend, sublicense, time-share or otherwise permit any other party to use the Software, Software Copies or Documentation or to exercise your rights under this Agreement.

  • This shall not, however, affect IMG's and its Distributors' and other sublicensees' right to continue to make and distribute Software Copies made by such parties pursuant to Section 6.1 above, provided that IMG shall not, after such discontinuance, market or distribute any discontinued Software Product under VERITAS' trademarks.

  • Royalty payments shall be due within forty-five (45) days after the end of each IMG fiscal quarter, based on Software Copies distributed by IMG during that quarter.

  • Subject to the foregoing, LA will report to Reseller the contact information for any potential End-User customer located within the Licensed Territory that contacts LA directly in regard to the purchase of Software Copies.

  • The Reseller's distribution license is limited to distribution of Software Copies in tangible packaged goods media, in the format(s) specified by LA, which may include without limitation CD-ROM or diskette, and no right or license is granted to distribute Software Copies via the Internet or any wide area network (WAN) or otherwise in electronic media, except as stated in the following two sentences.

  • All Software Copies distributed by the Reseller will be accompanied by a copy of the End User License Agreement, and the Reseller agrees to enforce the terms and conditions of the End User License Agreement in the event of any violation by an End-User.

Software Copies means the Sagent software capabilities (in object code form only) outlined in Exhibit A and licensed hereunder in accordance with this Agreement and for the fees outlined in Exhibit B which SAGENT allows ADVENT to embed as part of its solution.
Software Copies means the actual copies of or any portion of the SOFTWARE, including any backups, updates or partial copies. This SOFTWARE product is licensed to BUYER alone. It may be used only at the mini-storage for which it was purchased (see BUYER). Any current or subsequent employee may use SOFTWARE at the facility, but it may not be transported and used at any other facility, nor may it be used on more than one single computer. BUYER is permitted to make four backup copies solely for archival or backup purposes, and BUYER must keep possession of all backups. BUYER may not, under any circumstances, transfer SOFTWARE to another party. If this mini-storage facility is sold, the new purchaser may apply to be substituted in your place as the licensee of SOFTWARE. Purchaser shall pay a $100 transfer fee and is entitled to all remaining technical support and benefits due the original signer of this contract. Consent of substitution shall not be unreasonably withheld. BUYER may not make copies of the SOFTWARE or other PRODUCT provided by SELLER except as permitted above; nor may BUYER rent, lease, lend, sub-license or transfer the SOFTWARE, SOFTWARE COPIES or PRODUCT. BUYER may not alter, de-compile, disassemble or reverse-engineer the SOFTWARE, SOFTWARE COPIES OR PRODUCT, or make any attempt to unlock or bypass any copy-protection system(s) employed by SELLER or alter, remove, or obscure any copyright notice. The copy-protection device represents the full purchase price of the software. Any loss thereof will require full re-purchase of SOFTWARE. The license gives BUYER certain limited rights to use the SOFTWARE, load it into your computer's memory (RAM) and install it on a hard disk. SELLER retains title to the SOFTWARE, SOFTWARE COPIES, PRODUCT and any material provided by SELLER. This license is effective when BUYER receives QuikStor software and shall remain in effect for NINETY-NINE years or until BUYER returns, to SELLER, the SOFTWARE, SOFTWARE COPIES, PRODUCT and any material provided by SELLER. Both SELLER and BUYER agree not to provide any outside party with trade secrets or operational information that could harm the finances or reputation of either company. Software Copies means actual copies of all or any portion of the Software, including backups, upgrades, merged or partial copies that are permitted under the terms of TEKELEC's Software License (Appendix D). "Related Documents" refers to printed materials provided with Software or Software copies describing the Software, its installation, or its use. During the warranty period, TEKELEC will correct significant errors in the Software or Related Documents that render either unusable, as defined in the Category of Software Changes section below, with efforts TEKELEC believes suitable for the problem or, at TEKELEC's option, furnish Software Maintenance Loads or Feature Constant Generic Software Loads.

Related to Software Copies

  • Software Update means a release of Software, in object code form, or firmware, which provides minor fixes, improvements and modifications to the Software or Equipment. Kodak software releases that are designated as updates will be identified A.B.x where the x designates the release as a Software Update.

  • Business Software means with respect to a Licensor, all Software to the extent Controlled by such Licensor or any of its Affiliates as of the Effective Date, which Software is reasonably required as of the Effective Date for the conduct of (i) the Agriculture Business if the Licensee is AgCo, including as listed on section (i) of Schedule Q, or (ii) the Materials Science Business if the Licensee is MatCo, including as listed on section (ii) of Schedule Q, in each case (in respect of the foregoing (i) and (ii)), only if and to the extent such Licensee and its Affiliates have not been granted a license or other rights to use such Software under the Separation Agreement or any other Ancillary Agreement. Notwithstanding the foregoing, Business Software expressly excludes any and all Excluded IP.

  • Software means (a) all computer programs, including source code and object code versions, (b) all data, databases and compilations of data, whether machine readable or otherwise, and (c) all documentation, training materials and configurations related to any of the foregoing.
