For the avoidance of doubt, the Refining Fee only applies to transactions involving the sale of refined sugar and other products produced by the Facility (or, during its period of operation by the Company, produced by the Colonial Facility) and sold by the Company from raw cane sugar purchased by the Company from SUGAR pursuant to the Supply Agreement.
