Settlement Hearing means the hearing set by the Court under Rule 23(e)(2) of the Federal Rules of Civil Procedure to consider final approval of the Settlement.
Fairness Hearing means a hearing on the settlement proposed in this Settlement Agreement held by the Court to determine whether the proposed settlement is fair, reasonable, and adequate, and whether it should be finally approved by the Court.
Claims Deadline means the date by which all Claim Forms submitted by a person within the Settlement Class must be postmarked, which shall be designated as 30 days after the Final Approval Hearing. The Claims Deadline shall be clearly set forth in the Preliminary Approval Order as well as in the Notice and Claim Form.
Human being means a person who has been born and is alive.
Informed decision means a decision by a qualified patient, to request and obtain a prescription for medication that the qualified patient may self-administer to end his or her life in a humane and dignified manner, that is based on an appreciation of the relevant facts and after being fully informed by the attending physician of:
Sale Hearing means the hearing conducted by the Bankruptcy Court to approve the transactions contemplated by this Agreement.
State Fair Hearing means the process set forth in subpart E of part 431 of CFR Title 42. State Fiscal Year (SFY) means 12 calendar months commencing on July 1 and ending on June 30 following or the 12-month period for which the State budgets funds.
Open meeting or "public meeting" means a meeting at which the public may be present.
Public Director means a Person that meets the qualifications described in Rule 207(e).
Final Approval Hearing means the hearing to be conducted by the Court to determine the fairness, adequacy, and reasonableness of the Settlement pursuant to Federal Rule of Civil Procedure 23 and whether to issue the Final Approval Order and Judgment.
Public hearing means a hearing at which members of the public are provided a reasonable opportunity to comment on the subject of the hearing.
Responsive Proposal means a Proposal that complies with the material provisions of this RFP.
Fair Hearing means the State hearing provided to beneficiaries upon denial of appeal pursuant to 22 CCR 50951 and 50953 and 9 CCR 1810.216.6. Fair hearings must comply with 42 CFR 431.220(a)(5), 438.408(f), 438.414, and 438.10(g)(1).
Creditors’ Meeting means the meeting of the Affected Creditors called for the purpose of considering and voting upon the Proposal;
Permanency hearing means a hearing, conducted with respect to a child who is in foster care, to determine the permanency plan for the child which includes:
Public Disclosure means disclosure in a press release reported by the Dow Jones News Service, Associated Press or comparable national news service or in a document publicly filed by the corporation with the Securities and Exchange Commission pursuant to Section 13, 14 or 15(d) of the Exchange Act.
Comment means the findings and recommendations of the Council for- mally provided in writing to the head of a Federal agency under section 106.
Public Trading Date means the first date upon which Common Stock is listed (or approved for listing) upon notice of issuance on any securities exchange or designated (or approved for designation) upon notice of issuance as a national market security on an interdealer quotation system.
