It applies to Personal Data, Sensitive Personal Data, Personal Confidential Data and non-personal information.
Data Means the data including Personal Confidential Data to which a Provider Partner or a Provider Partner's contractor contributes and/or has access as a result of this Agreement.
For the avoidance of doubt this shall include: acting as lead for the maintenance & configuration of the Health Information Exchange (HIE) system; managing complaints or a potential/suspected unauthorised release, disclosure or access to Partners’ Personal Confidential Data or any part thereof; and conducting system audits when and where required.
This Data Processing Agreement shall apply to the services under that Agreement, and in particular the details contained therein outlining the subject-matter and duration of the Processing, the nature and purpose of the Processing, the type of Partners’ Personal Confidential Data and categories of Data Subjects.
This document contains a description of the technical and organizational measures which have been taken by the Data Importer to protect Personal Confidential Data within the scope of the Data Importer's activities.
Provided any disclosure is in accordance with this agreement, each Partner Organisation shall share Personal Confidential Data when it is needed for the safe and effective care of an individual.

Access to Personal Confidential Data (PCD) will only be allowed where there is 1) a strictly defined legitimate relationship OR 2) there is a legal gateway that allows it.
Such measures shall include appropriate technical and organisational measures for pseudonymisation data minimisation; and ensuring that all employees and contractors who are involved in the Processing of Partners’ Personal Confidential Data are suitably trained in maintaining the privacy and security of the Partners’ Personal Confidential Data and are under contractual or statutory obligations of confidentiality concerning the Partners’ Personal Data.
No Personal Confidential Data is envisaged to be handled in this project; however, advice can be sought from the UKHSA Caldicott Guardian where needed.
