Optimizely Software is defined in the Software Services User Agreement, but in the absence of that definition in the applicable Agreement it means for the purposes of this SLA, Optimizely-owned software.

Examples of Optimizely Software in a sentence

  • As between Optimizely and Customer, Optimizely shall have sole and exclusive ownership of all right, title, and interest in and to the Software Service, including all Optimizely Software, Documentation and Optimizely Material, all copies, improvements, and derivative works, including all copyright, trademark, patent, trade secret, know-how, and all other associated Intellectual Property Rights.

  • Optimizely will defend Customer against claims brought against Customer and its Affiliates by any Third Party alleging that Customer’s and its Affiliates’ Use of any Optimizely Software, Documentation or Optimizely Material, infringes or misappropriates a patent claim, copyright, or trade secret right (“IP Claims”).

  • Customer will comply with any additional applicable license terms of that Optimizely Software it may Use that Optimizely publishes in conjunction with that Optimizely Software.

  • For some Software Service, Optimizely may recommend in the Documentation certain Optimizely Software for Customer to consider utilizing as Enhancements for its Use of the Software Service.

  • Tyler Software means our proprietary software, including any integrations, custom modifications, and/or other related interfaces identified in the Investment Summary and licensed by us to you through this Agreement. • “we”, “us”, “our” and similar terms mean ▇▇▇▇▇. • “you” and similar terms mean Client.

  • Supplier Software means software which is proprietary to the Supplier and software which is or will be used by the Supplier for the purposes of providing the Placement Services;

  • Server Software means software that provides services or functionality on a computer acting as a server.

  • Customer Software means software which is owned by or licensed to the Customer, including software which is or will be used by the Supplier for the purposes of providing the Goods and/or Services but excluding the Supplier Software;

  • System Software means machine-readable data and executable programs used to define the functionality of the HPS control system and standard hardware products, but does not include firmware, operating system, application software or other software products.
