• Similarly, Contractor shall not use any Information received from Company for any purpose other than the design, procurement of the Facility, construction or such other Work as required for the performance of the Contract.

• The Interconnection Agreement shall be in full force and effect prior to the start of Facility construction and as of the Commercial Operation Date or the Initial Delivery Date, as applicable.

• Insurance coverage required by Section 16 shall be in full force and effect prior to the start of Facility construction and as of the Commercial Operation Date or the Initial Delivery Date, as applicable.

• Seller shall maintain or cause to be maintained during the construction of the Facility, construction all-risk form property insurance covering the Facility during such construction periods, and naming Seller (and Lender if any) as the loss payee.
