ECM Loan Documents definition

ECM Loan Documents means, collectively, that (i) Note Purchase Agreement dated as of April 20, 2007 between Borrower and Ethanol Investment Partners, LLC (“EIP”), (ii) the 15% Subordinated Convertible Promissory Note issued by Borrower to EIP on April 27, 2007 in the original principal amount of $10,000,000, and (iii) the 15% Subordinated Convertible Promissory Note issued by Borrower to EIP on June 20, 2007 in the original principal amount of $15,929,436, together with all amendments, supplements, agreements, documents, exhibits, schedules and certificates contemplated thereby or entered into in connection with any of the foregoing.

Related to ECM Loan Documents

  • DIP Loan Documents means the Replacement DIP Loan Documents (as defined in the DIP Order).

  • Term Loan Documents means the “Loan Documents” as defined in the Term Loan Credit Agreement.

  • Senior Loan Documents means the loan agreement between Borrower and Senior Creditor and any other agreement, security agreement, document, promissory note, UCC financing statement, or instrument executed by Borrower in favor of Senior Creditor pursuant to or in connection with the Senior Debt or the loan agreement, as the same may from time to time be amended, modified, supplemented, extended, renewed, restated or replaced.

  • Second Lien Loan Documents means the Second Lien Credit Agreement and the other “Loan Documents” as defined in the Second Lien Credit Agreement.

  • ABL Loan Documents means the “Loan Documents” as defined in the ABL Credit Agreement.
