Metro will be reimbursed for third party costs incurred in connection with the development of the County Properties as follows: Metro will receive 100% reimbursement of the third party costs incurred for the Department of Public Social Services Site and 100% reimbursement of the third party costs incurred for the Probation Department Site with the exception of any costs which are customarily recovered from the developer.
County shall retain all rights to collect rents and payments and to otherwise enforce the terms and provisions of any leases from time-to-time in effect on the County Properties, and nothing contained herein constitutes a delegation to BLM of any right to do so.

At the Closing, St. J▇▇▇▇▇ County Properties, LLC and Seller shall execute the Mishawaka Agreement in substantially the form of attached Exhibit 4.b.
That County may discharge sewage from the County Properties through the City Sewage System.
It is the intention of the County that 50% of the principal and interest in the Trust Account for the property shall be available at any time to fund work related to planning and implementing general management, agricultural management, maintenance, operation and improvements on the County Properties in a manner consistent with restoration, enhancement and protection of the natural features and communities found on the County Properties and neighboring properties.
Metro will not assume any liability or obligation to remediate the County Properties as part of this agreement.
