Coal Property definition

Coal Property means any fee, surface or mineral estate in Appalachia purchased, leased or then held, by a Partner or any Affiliate with the primary intention of exploring for or developing or recovering coal, or any property or interest in Appalachia with respect to which any Partner or an Affiliate is then actually exploring or developing or recovering coal. "Code" mans the Internal Revenue Code of 1986, as amended.
Coal Property means the real property, mineral interests, preparation plant facilities, loading facilities, and other improvements located in Lxxxxx County, Kxxxx County, Perry County, Hxxxxx County, Pike County, Bxxx County, and Lxxxxxx County, Kentucky, as outlined on the maps that are identified as Annex A, which is attached hereto and made a part of this Agreement.
Coal Property as used in the Terms and Conditions on Schedule C attached hereto shall mean the physical location at which the coal sold hereunder is mined.

Examples of Coal Property in a sentence

  • Seller represents and warrants that the Coal Property contains economically recoverable coal of a quality and in quantities which will be sufficient to satisfy all the requirements of this Agreement.

  • Seller agrees and warrants that it will have at the Coal Property adequate machinery, equipment and other facilities to produce, prepare and deliver coal in the quantity and of the quality required by this Agreement.

  • Seller agrees and warrants that it will not, without Buyer's express prior written consent, use or sell coal from the Coal Property in a way that will reduce the economically recoverable balance of coal in the Coal Property to an amount less than that required to be supplied to Buyer hereunder.

More Definitions of Coal Property

Coal Property means the real property, mineral interests, preparation plant facilities and loading facilities, with improvements thereto, referred to as the Buckskin Mine and the North Rochxxxx Xxxe, both located in Campxxxx Xxxnty, Wyoming and the other approved coal properties described in Appendix A.

Related to Coal Property

  • Operating Property means any property owned, leased, or operated by the Party in question or by any of its Subsidiaries or in which such Party or Subsidiary holds a security interest or other interest (including an interest in a fiduciary capacity), and, where required by the context, includes the owner or operator of such property, but only with respect to such property.

  • Mining Property means a property used for mining operations as defined in the Mineral and Petroleum Resources Development Act, 2002 (Act No. 28 of 2002);
