CBHA definition

CBHA means and includes Columbia Basin Health Association, its partners, licensors, and any and all subsidiaries, affiliated entities, or entities that control, are controlled by, or are under common control with CBHA singly or together and its and each of their officers, employees, contractors, subcontractors and agents and each of their agents, representatives, successors and assigns; and (b) “you” or “your” means and includes you (as an individual) and all other Registered Parties for whom you are registering, and by virtue of agreeing to this Agreement and Waiver, for whom you are waiving certain rights. If you are registering a child under the age of 18 or an incapacitated adult you represent and warrant that you are the parent or legal guardian of that party and have the legal authority to enter into this Agreement and Waiver on their behalf and by proceeding with registration for the Event, you agree that the terms of this Agreement and Waiver shall apply equally to all of the Registered Parties. To the extent permitted by law, each person agreeing to this Agreement and Waiver for him/herself and/ or on behalf of another Registered Party (including, without limitation, any minor) agrees to indemnify, defend, and hold CBHA harmless from any liability, claim, demand, cause of action, damage, loss, or expense (including court costs and reasonable attorneys’ fees) of any kind or nature (each, a “Liability” and collectively “Liabilities”) in the event the Liability arises because a Registered Party is found by a court of competent jurisdiction to not be bound by the terms and conditions of this this Agreement and Waiver. In addition, if, despite this Agreement and Waiver, any of the Registered Parties makes a claim against CBHA you agree, immediately upon request or demand by CBHA to defend, indemnify and hold CBHA harmless from all Liabilities which may be incurred as the result of such claim.

  • CBHA understands that items or services furnished by excluded persons are not payable by Federal health care programs and that CBHA may be liable for overpayments and/or criminal, civil, and administrative sanctions for employing or contracting with an excluded person regardless of whether CBHA meets the requirements of Section III.F.

  • If, at any time, CBHA identifies any Overpayment, CBHA shall repay the Overpayment to the appropriate payor (e.g., Medicare contractor) in accordance with the requirements of 42 U.S.C. § 1320a-7k(d) and any applicable regulations and guidance from the Centers for Medicare and Medicaid Services (CMS).

  • CBHA shall have 30 days from the date of OIG’s written notice to provide information regarding the IRO’s qualifications, independence or performance of its responsibilities in order to resolve the concerns identified by OIG.

  • Homecare Worker means a provider, as described in OAR 411-031- 0040, that is directly employed by a consumer to provide either hourly or live-in services to the eligible consumer.

  • Environmental and Social Management Framework or “ESMF” means the environmental and social management framework of the Project States dated March 31, 2005, which, inter alia, sets forth the environmental and social safeguards applicable to the Project including the identification, assessment and mitigation of potential environmental and social impacts arising from carrying out Project activities, measures to protect cultural property, proposed management and mitigation measures, and the relevant institutional framework required, as updated by the Project States from time to time in a manner satisfactory to the Association;

  • SSE means the Shanghai Stock Exchange.
