Bomgar Software definition

Bomgar Software means the package of proprietary computer software programs, in Object Code as identified on the Order Form. Unless specifically indicated or the context requires otherwise, the term Bomgar Software shall include all Upgrades to the Bomgar Software provided to Customer by Licensor.

Examples of Bomgar Software in a sentence

  • If any Bomgar Software becomes or, in Licensor’s opinion, is likely to become the subject of any injunction preventing its use as contemplated herein, Licensor may, at its option, (i) procure for Customer the right to continue using such Bomgar Software, (ii) replace or modify such Bomgar Software so that it becomes non- infringing without substantially compromising its functionality.

  • Except as may otherwise be provided in the Third Party Software license agreements, Customer’s license to Third Party Software terminates at such time as Customer’s license to the Bomgar Software terminates.

  • If Licensor selects option (ii) or (iii), Customer shall immediately refrain from use of the allegedly infringing Bomgar Software.

  • Tyler Software means our proprietary software, including any integrations, custom modifications, and/or other related interfaces identified in the Investment Summary and licensed by us to you through this Agreement. • “we”, “us”, “our” and similar terms mean ▇▇▇▇▇. • “you” and similar terms mean Client.

  • Customer Software means software which is owned by or licensed to the Customer, including software which is or will be used by the Supplier for the purposes of providing the Goods and/or Services but excluding the Supplier Software;

  • System Software means machine-readable data and executable programs used to define the functionality of the HPS control system and standard hardware products, but does not include firmware, operating system, application software or other software products.

  • SAP Software means: (i) any and all software products and Cloud Services licensed to Customer under the License Agreement as specified in software order forms or Cloud Service Order Forms (or other order forms, schedules or appendices as applicable) thereto; (ii) any new releases, updates or versions thereof made available through unrestricted shipment pursuant to the respective support agreement or warranty obligation and (iii) any complete or partial copies of any of the foregoing.
