Approved Deviations definition

Approved Deviations means the deviations from WMATA Design Criteria and Requirements for Phase 2 (i) that have been approved by WMATA as of the date of this Agreement (listed on Exhibit 4), (ii) that are requested by MWAA or Contractors and are approved by WMATA during the term of this Agreement in accordance with the provisions of Section 3.2, or (iii) are initiated by WMATA and agreed to by MWAA or the Coordinating Committee during the term of this Agreement pursuant to the provisions of Section 3.2.

Examples of Approved Deviations in a sentence

  • The RFP Documents or the Design-Build Proposal, with the exception of Approved Deviations, the Contract Documents shall not include any portion of the Design-Build Proposal that deviates from the Project Criteria.

  • Existing Improvements at the Site, for which no specific description is made in the Project Criteria or Approved Deviations, but which could be reasonably assumed to interfere with the satisfactory completion of the Work, shall be removed and disposed of by the CONTRACTOR without Contract Adjustment.

  • District and Design-Build Entity acknowledge that questions may arise concerning the level and scope of performance required under the RFP Documents, Design-Build Contract, General Conditions, Project Criteria, Design Intent or Approved Deviations.

  • Items missing from the Contract Documents shall nevertheless be provided by the Design-Build Entity, without Contract Adjustment, to the extent reasonably inferable from the Contract Documents as being necessary to satisfy the Project Criteria, Approved Deviations and the Design Intent.

  • Statements in the Contract Documents to the effect that Design- Build Entity shall comply with or conform to the requirements of the Contract Documents shall not be interpreted as relieving the Design-Build Entity from any responsibility to correct any Design Deficiency in the Construction Documents, Approved Deviations or other Contract Documents prepared by Design-Build Entity or its Subcontractors or Subconsultants.

  • Under no circumstances shall any general or specific approval by District of Construction Documents that contain a deviation from the RFP Documents, Design-Build Contract, General Conditions, Project Criteria, Design Intent or Approved Deviations previously approved by District pursuant to this Paragraph 3.2.5 be interpreted as implying approval by District of such deviation unless such deviation has been approved by District in the manner required by Subparagraph 3.2.5.2, above.

  • Existing Improvements at the Site, for which no specific description is made in the Project Criteria or Approved Deviations, but which could be reasonably assumed to interfere with the satisfactory completion of the Work, shall be removed and disposed of by the Design-Build Entity without Contract Adjustment.

  • The Final Construction Drawings to be hereafter prepared by the Design-Builder and its Subconsultants that are approved by the District in accordance with the terms of the Contract Documents; provided, however, that, with the exception of Approved Deviations, the Contract Documents shall not include any portion of the Design-Build Proposal that deviates from the Project Criteria.

  • The Final Construction Drawings and Technical Specifications to be hereafter prepared by the Design-Builder and its Subconsultants that are accepted by the District and approved by the DSA in accordance with the terms of the Contract Documents; provided, however, that, with the exception of Approved Deviations, the Contract Documents shall not include any portion of the Design-Build Proposal that deviates from the Project Program or Criteria.

  • The Final Construction Drawings to be hereafter prepared by the Design-Builder and its Subconsultants that are approved by the County in accordance with the terms of the Contract Documents; provided, however, that, in the exception of Approved Deviations, the Contract Documents shall not include any portion of the Design-Builder Proposal or a Best and Final Offer that deviates from the Project criteria.

  • Approved Device means a device described in Subsection 20A-21-201(4) used to

The failure of this Agreement to describe any other permit, condition, or term of restriction applicable to the Property does not relieve Developer of the necessity of complying with the same.
