AP Competitor definition

AP Competitor means any of the following entities and their affiliates (other than the Purchaser and any of its affiliates): (A) [***]; (B) [***]; and (C) [***]. and excluding any entity that the Seller and the Purchaser agree shall not be an AP Competitor for these purposes; For the purposes of this definition, (i) AP means both APs and AP Products and (ii) [***].
AP Competitor means any of the following entities and their affiliates (other than the Purchaser and any of its affiliates): (A) the top ten (10) sellers of any of (i) CPUs, (ii) APs or (iii) CPUs and APs, as determined by the annual volumes sold of CPUs, APs or, where a seller and its affiliates sells both CPUs and APs, both CPUs and APs, by such sellers and their affiliates based on the figures reported in the Relevant Report; [***] Information has been omitted and filed separately with the Securities and Exchange Commission. Related to AP Competitor

  • Direct Competitor means any individual, partnership, corporation, limited liability company, association, or other group, however organized, who competes with the Company in the full service restaurant business.

  • Competitor means any company, other entity or association or individual that directly or indirectly is engaged in the Company’s Business.

  • Company Competitor means any competitor of the Borrower and/or any of its subsidiaries.
