By no later than (i) fifteen (15) Business Days after receipt of such notice, or (ii) the date set forth for Agency’s review in the current Accepted Project Implementation Plan and Schedule, Agency will determine whether the Deliverable meets Acceptance Criteria set forth in the Contract.
If any Accepted Project becomes a Deficient Project or Cancelled Project, all risk of loss or damage to such Project shall pass back to such Seller and, if the Customer Agreements related thereto have not been terminated, such Customer Agreements shall be reassigned to such Seller by Purchaser.
Contractor shall perform the Services as set forth in the Statement of Work, in accordance with the current, Accepted Project Implementation Plan and Schedule and the standards and methodologies set forth in the Statement of Work and elsewhere in this Contract.
Any request for an extension of the Contract Time must be based on the Accepted Project Schedule.
If at any time a Party so elects not to proceed with preparing or submitting a Joint Proposal for an Accepted Project Opportunity and has made an express and definitive statement accordingly, in writing and signed by at least one of that Party’s representatives in the Project Coordination Committee, then the other Party shall be free to submit a Proposal, alone or with a third party, as described in Section 4.1.4.

Damages If Final Acceptance does not occur on or before the date agreed to in the current Accepted Project Implementation Plan and Project Schedule, then Contractor will be liable for all additional project costs incurred by Agency beyond the specified Final Acceptance date that would not have otherwise been incurred.
Beginning fifteen (15) Calendar Days prior to the end of the Pilot period set forth in the current Accepted Project Implementation Plan and Schedule, if ▇▇▇▇▇ ▇, ▇▇▇▇▇ ▇, or Level 3 Defects are discovered, Agency will notify Contractor of the Defect orally or in writing as soon as reasonably practicable, and will provide written notification of the Defect(s) no later than three (3) Business Days after discovery, and specify its level.
D-BE shall not be entitled to an extension of the Contract Time unless D-BE demonstrates a delay to the critical path shown on the most recent Accepted Project Schedule.
