Communication. Our contractual partners are obliged to treat any correspondence with us with special diligence. Particularly, all current „best practices“ ensuring a secure exchange of information, integrity of any message content and the reliable identification of sender and receiver must be strictly followed and have to be implemented (especially: scrutiny of e-mail-headers and signatures). Our contractual partners are fully liable for the safety and security of all information exchanged and have to fully indemnify us for any damage arising out of or in connection with any unauthorized access to and/or abuse of their internal or external IT-infrastructure or any other breach of their obligations out of this section.
Communication. 1. All communications of the Issuer relating to the Tokenized Stocks shall be made, unless otherwise required by law, by electronic publication on the website of the Issuer (xxxxx://xxx.xxxxxxxxxxxxx.xx) and/or in text form by e-mail. Each notice shall be deemed to have been effectively given and received by the investors on the third day after the day of publication.
Communication. Electronic Communication The communication with the customer takes place in principle electronically over the Vantik platform or by E-Mail. Documents (e.g. information documents, sales brochures, communications, invoices, contract documents) will normally be provided to the customer by Vantik in his electronic mailbox on the Vantik platform. The telephone service offered by Vantik as well as the chat function made available on the Vantik platform remains unaffected by this. Orders can be given however neither by telephone nor over the Chat function. The customer agrees to an electronic communication and renounces in this respect the postal dispatch of documents. However, Xxxxxx is entitled to deliver provided documents generally or in individual cases by post, if a postal delivery is necessary due to legal specifications or Vantik considers this to be expedient under consideration of the interests of the customer. Authorisation to receive In order to ensure a uniform and smooth flow of correspondence, Xxxxxx is authorised to receive on behalf of the client all information and documents transmitted by the custodian bank, the fund company or other service werden, für den Kunden in Empfang zu nehmen. Tout comme des dommages liés à l'appareil (connecté) utilisé pour l'opération de paiement ou bien de la réalisation électronique du paiement (p.ex. causés par des lo- giciels malveillants ou similaires) ne relèvent pas de la responsabilité d'EC. Finalement, EC décline aussi toute responsabilité des dommages causés par un abus des données, une défaillance technique ou l'utilisation de la connexion à internet. La collecte, le traitement et l'utilisation de vos données personnelles est indispensable pour permettre le mode de paiement ASF. En utilisant le mode de paiement ASF, vous consentez explicitement à ce qu'EC traite, avant et/ou pendant la conclusion du contrat, vos données personnelles, telles le prénom et le nom; l'adresse; la date de naissance; les adresses e-mail; les numéros de téléphone fixe et mo- bile; les informations relatives à la gestion de la commande et du paiement. Les données personnelles sont utilisées afin de procéder à la vérification d'identité et à l'examen de solvabilité. L'examen de solvabilité comprend, entre autres, des calculs s'appuyant sur une base informatique pour détermi- ner le risque d'un défaut de paiement ultérieur. Le but du traitement des données enregistrées est de fournir des renseignements quant à la solvabilité de la personne/société demandée. Les informa- tions disponibles peuvent aussi être utilisées dans les domaines de la publicité/du marketing direct, dans la lutte contre le blanchiment d'argent ou pour les croiser avec des listes de sanctions. Ensuite, EC est en droit d'utiliser aussi des informations publiquement accessibles issues d'internet à des fins d'identification en cas de risque d'abus...
Communication. If communications are sent by EC to the last (e-mail) address provided by you in writing, these shall be deemed to have been validly delivered. Furthermore, EC is entitled to contact you through your landline or mobile phone number. You are then obliged to inform EC immediately in writing of any changes to your contact details. A general exclusion of liability applies to the maximum extent permitted by law. In particular, EC shall not be held liable for any damage incurred if the POA payment method is not available at the online retailer or at EC for technical or other reasons. Furthermore, EC disclaims any liability in connection with the underlying transaction between you and the online retailer. Moreover, EC shall not be held liable for any damage to the (internet-enabled) device used for the payment transaction or electronic payment processing (e.g. due to malware or similar). Finally, EC also accepts no liability for damage caused by misuse of data, technical faults or use of the internet connection. The collection, processing and use of personal data is an indispensable prerequisite for enabling the POA payment method. By using the POA payment method, you expressly agree that EC may, before and/or during the execution of the contract, process your personal data, such as first name and sur- name; address; date of birth; e-mail addresses; landline and mobile telephone numbers; information relating to order and payment processing. This personal data is used for the purpose of checking your identity and credit rating. The credit check includes, among other things, IT-based calculations about the risk of a potential payment default at a later date. The purpose of processing the stored data is to provide information on the credit rating of the person/company in question. The information held can also be used for direct advertising/marketing, combating money laundering or for cross-checking against sanctions lists. Further, EC is entitled to use publicly available information from the internet for the purpose of iden- tification if there is a risk of misuse and/or fraud. In order to assert claims, the online retailer shall hand over the necessary documents such as the order, order data, customer details, invoices, etc. to EC. These are processed for the purpose of en- forcing the claim. If necessary, third parties such as lawyers or authorities shall be consulted. Communication. 7.1 By submitting an Application, the Depositor agrees that the communication in connection with the conclusion and performance of the Term Deposit Contract with J&T shall be performed in writing in the English language, through electronic notifications and exchange of documents in electronic format via the Internet Platform. Where expressly specified in the present General Terms and Conditions, the documents shall also be sent in the original paper form. Should the Depositor request to receive additional documents or notifications in electronic or paper format, J&T can provide him/her with those upon payment of respective fees. 7.2 The documents shall be deemed received by the Depositor from the time he/she receives an electronic confirmation. 7.3 Any documents and notifications received in J&T after 15:00 CET shall be deemed received by it on the next Business Day. 7.4 J&T reserves the right, in case of technical problems of the Internet Platform, to deliver documents and notifications in paper form, pursuant to item 7.2 above. 7.5 All documents and notifications sent to the Depositor pursuant to these General Terms and Conditions shall be considered duly received by him/her. J&T shall not be liable to the Depositor for damages caused in case of non-notification, or delay in receipt of notification. 7.6 J&T reserves the right to send documents or notifications in paper form, to the address specified by the Depositor, if circumstances so require (e.g. cessation of relations with biw and/or Savedo, etc.) 7.7 In order to fulfil the obligations arising for J&T under the appropriate legal regulations, particularly the Czech Act on Measures against the Legalization of Proceeds of Crime and the Czech Capital Market Undertakings Act and for the purpose of fulfilling the obligations under the performance of supervision, J&T is authorized, even without Client's consent or without informing the Client or other affected persons about: 7.7.1 ascertaining, obtaining, recording, storing, using or otherwise processing personal data or other Confidential Information that pertains to the Client and/or other affected persons in the scope and in the way set out in the pertinent legal regulations, particularly the Czech Act on Measures against the Legalization of Proceeds of Crime, the Czech Capital Market Undertakings Act and the Personal Data Protection Act,
