Common use of Your California Privacy Rights Clause in Contracts

Your California Privacy Rights. This section applies to any California residents about whom we have collected personal information from any source, including through your use of our Website(s), by buying our products or services, or by communicating with us electronically, in paper correspondence or in person. As a financial services company, TMCC applies privacy and security protections to your personal information as required by US federal law. As such, certain personal information that we may collect and process about you to deliver our financial products and services is exempt from the California Consumer Privacy Act (“CCPA”). In furtherance of our commitment to consumer transparency and privacy for our valued customers, we are providing you with details on the sources, uses, and similar details of the personal information we may process about you. Please keep in mind, however, that our decision to provide you this information is done solely on a voluntary basis and in no way suggests TMCC is doing so because it is required to do so under the CCPA or any other legal obligation. Therefore, TMCC reserves the right, in our sole discretion, to determine the amount and type of information we disclose to you in the future or how to respond to privacy requests that you may submit to us. For purposes of this section, “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California consumer/resident or household. Personal information does not include publicly available information or information that has been de-identified.
