WORKWEEK & OVERTIME a. Workweek The normal workweek for employees covered by this Agreement shall be Monday through Friday consisting of forty (40) working hours. The City may establish a workweek schedule consisting of forty (40) hours in increments of four ten (10) hour workdays or five eight (8) hour workdays, or a 9-80 workweek schedule consisting of four nine (9) hour workdays, four nine (9) hour workdays, and one eight (8) hour workday during an eighty (80) hour bi-weekly period. The City agrees to discuss with the Union thirty (30) days in advance of implementation of the four ten (10) workweek or 9-80 workweek schedule.

WORKWEEK & OVERTIME. Forty (40) hours per week shall be considered the normal workweek. Eight (8) hours shall be considered the normal work day, exclusive of the meal period. If the meal period is interrupted, the entire meal period shall be considered time worked. Hours actually worked in excess of forty (40) hours in one (1) week shall be paid one and one-half (1 1/2) times the regular rate of pay. For the purposes of administering this Article, the work day shall begin at 12:00 a.m. and the workweek shall begin at 12:00 a.m. on Sunday. The Employer may establish flexible work schedules. Departments are encouraged to establish flexible work schedules and to give serious consideration to employee requests. Individual requests for flexible scheduling may be approved by the Employer, provided that such scheduling does not interfere with the effective operation of the department and shall be dependent upon such considerations as building accessibility and security.

WORKWEEK & OVERTIME a. The workweek for pay purposes shall commence at 12:01 a.m. Sunday and conclude on the following Saturday midnight. The normal workweek within that period will consist of five (5) consecutive days. Additional time required by the supervisor for an employee to work shall be compensated with time and one-half at that employee’s regular rate of pay. An employee in the bargaining unit shall not be required to work in addition to eight (8) hours per day or forty (40) hours per week without compensation of time and one-half of that employee’s regular rate of pay. Compensatory time off by agreement of the employee and his/her supervisor can be granted in lieu of monetary pay at the rate of one and one-half hours credit for each hour worked in excess of forty (40) hours in any one workweek or in excess of eight (8) hours in any one day. The supervisor and an employee may agree to modify the work schedule to allow for four (4) ten (10) hour days. In the event an employee is required to work beyond ten (10) hours a day or forty (40) hours a week he/she shall receive overtime compensation for the additional hours. Compensatory time shall apply if the district initiates the request or if the employee notifies the district of need and the district agrees to the extended work schedule. In addition, if an employee desires to flex his or her regular daily schedule they may request a shift in their work hours beyond the standard eight (8) hour day without any overtime obligations as long as the employees work week does not exceed forty (40) hours in the week and the supervisor approves the request.

WORKWEEK & OVERTIME. Substitution (2018)‌ An employee in the bargaining unit shall not be required to work in excess of forty (40) hours a week, without compensation of time and one-half that of the employee’s hourly rate of pay as required by the Fair Labor Standards Act (FLSA). Compensatory time in lieu of payment may be authorized and granted by the employee’s supervisor. Compensatory time in lieu of payment may be granted upon the request of the employee provided that such compensatory time is used within a time as approved by your supervisor and does not unduly disrupt the operations of the district. Such compensatory time will be at the rate of time and one-half for each of the overtime hours worked. If an employee works 40 hours prior to the completion of a work week he may be given time off, as a work week adjustment, for the balance of that work week. Overtime hours are permitted only on prior written approval of the supervisor, except in emergency situations. In emergency situations, an employee may be permitted to work overtime hours or hours exceeding eight per day with the verbal approval of his supervisor. In such emergency situations, the supervisor will verify the verbal approval in writing the next workday. No compensatory time shall be carried over into the next fiscal year. An employee who performs work during a designated holiday shall receive the overtime rate for all hours worked. Designated holidays include: Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Christmas Day, and New Year’s Day. Support personnel may be employed in more than one position provided the total regularly scheduled hours in the several positions does not exceed 40 hours per week. The rate of pay for additional positions shall start, upon assumption, at the base rate (step 1) for that position. Leave accrual will be commensurate with the schedule for the aggregate term worked. A support employee may temporarily substitute, when so designated, to fill a vacant authorized position provided the total scheduled work does not exceed forty (40) hours per week. The rate of pay will be fifty cents ($.50) per hour above the District's Minimum Wage Rate. No leave will accrue.
