Common use of Waiver; Partial Invalidity Clause in Contracts

Waiver; Partial Invalidity. If either the Landlord or Tenant should excuse or condone any default by the other of any obligation under this Lease, this shall not constitute a waiver of such obligation in respect of any continuing or subsequent default; and in no event shall any waiver be implied. All of the provisions of this Lease are to be construed as covenants even though not expressed as such. If any such provision is held or rendered illegal or unenforceable, then it shall be considered separate and severable from this Lease and the remaining provisions of this Lease shall remain in force and effect to bind the parties as though the illegal or unenforceable provision had never been included in this Lease.
