Vehicle Count Changes. CONTRACTOR acknowledges that throughout the term of this agreement [SCHOOL] will be engaged in efforts to improve the efficiency of its transportation operation. CONTRACTOR further warrants that pricing provided on the Rate Form will not change if [SCHOOL] increases or reduces the number of buses in use by 10 percent of the number of buses used on the last day of the previous school year. Any increase or decrease above 10 percent will result in a negotiation of any pricing change between [SCHOOL] and CONTRACTOR. Payments to Constitute a Current Expense of [SCHOOL]. The obligation of [SCHOOL] to make the required payments hereunder will constitute a current expense of [SCHOOL], are from year to year and do not constitute a mandatory payment obligation of [SCHOOL] in any fiscal year beyond the then current fiscal year of [SCHOOL]. [SCHOOL]’ obligations will not in any way be construed to be an indebtedness or obligation of [SCHOOL] in contravention of any applicable law.

Vehicle Count Changes. Harlow’s acknowledges that throughout the term of this agreement BPS will be engaged in efforts to improve the efficiency of its transportation operation. Harlow’s further warrants that pricing provided on the Rate Form will not change if BPS increases or reduces the number of buses in use by 10 percent of the number of buses used on the last day of the previous school year. Any increase or decrease above 10 percent will result in a negotiation of any pricing change between BPS and Harlow’s.
