UTLITIES. During the terms of this Lease, Lessee shall pay all charges and deposits for gas, electricity, water, sewer, refuse, janitorial and snow and ice removal from all areas not including roof or structural components. Lessee shall pay all charges and deposits for telephone, data, and any other utilities or services supplied to the Leased Premises. If any such utilities or services are not separately metered to Lessee, Lessee shall pay its pro- rate share as mutually agreed by both parties. Lessee agrees to transfer all utilities to Lessee’s name on the day of occupancy.
UTLITIES. Tenant shall pay, directly to the provider of such services, as the same shall become due, all charges for water, gas, electricity, telephone, telex and other electronic communications service, sewer service, waste pick-up and any other utilities, materials or services furnished directly to or used by Tenant on or about the Premises during the Lease Term, including, without limitation, any temporary or permanent utility surcharge or other exactions whether or not hereinafter imposed. If any such services and utilities are jointly metered and not directly billed to Tenant, Tenant shall pay an equitable portion of all charges as Additional Rent, with the determination of Tenant's equitable portion to be made by Landlord. In the event of a dispute between Landlord and Tenant regarding the calculation of such portion, Landlord may install separate meters as an Operating Cost pursuant to Paragraph 9. Tenant shall pay for any and telecommunication or other utility system modifications or additions which it may require and which Landlord expressly agrees to provide pursuant to the terms of this Lease or any subsequent written agreement; provided, however, that nothing in this Lease shall require Landlord to provide, modify or install any utility system or utility system component for Tenant's use except to the extent that the same is required b law or by an express written agreement between Landlord and Tenant. Landlord shall not be liable for, and Tenant shall not be entitled to, any abatement or reduction of Rent or other compensation by reason of any interruption or failure of utility services to the Premises.
UTLITIES. Seller shall obtain utility meter readings to a date not more than five (5) days before the Closing Date and the unfixed water rates and charges, sewer taxes and rents and gas and electricity charges, if any, based thereon for the intervening time shall be apportioned on the basis of such last readings. If such readings are not obtainable by the Closing Date, then, at the Closing, any water rates and charges, sewer taxes and rents and gas and electricity charges which are based on such readings shall be prorated based upon the per diem charges obtained by using the most recent period for which such readings shall then be available. Upon the taking of subsequent actual readings, the apportionment of such charges shall be recalculated and Seller or Buyer, as the case may be, promptly shall make any applicable payment to the other based upon such recalculations. In the event Seller has previously made any utility deposits for services at the Property, then Seller shall elect whether to receive a credit for such amounts at Closing or to request a reimbursement of the deposit from the applicable utility provider.
UTLITIES. Tenant shall be responsible for payment of the following utilities attributable to tenant: garbage, refuse, and rubbish collection relating to the Trailer and designated area surrounding the Trailer.

  • Staffing Consultant will designate in writing to Authority its representative, and the manner in which it will provide staff support for the project, which must be approved by Authority. Consultant must notify Authority’s Contract Representative of any change in personnel assigned to perform work under this Contract, and the Authority’s Contract Representative has the right to reject the person or persons assigned to fill the position or positions. The Authority’s Contract Representative shall also have the right to require the removal of the Consultant’s previously assigned personnel, including Consultant’s representative, provided sufficient cause for such removal exists. The criteria for requesting removal of an individual will be based on, but not limited to, the following: technical incompetence, inability to meet the position’s qualifications, failure to perform, poor attendance, ethics violation, unsafe work habits, or damage to Authority or other property. Upon notice for removal, Consultant shall replace such personnel with personnel substantially equal in ability and qualifications for the positions and shall submit the proposed replacement personnel qualification and abilities to the Authority, in writing, for approval.

  • Quality All products will be new and unused. All products provided by the Contractor must meet all federal, state, and local standards for quality and safety requirements. Products not meeting the requirements of this section will be deemed unacceptable and returned to the Contractor for credit at no charge to the State.
