UTILISATION DES SERVICES. 2.1. Droit d’utilisation. Sous réserve et à condition que vous payiez les Frais applicables (tels que xxxxxxx xx-dessous), et que vous respectiez toutes les autres conditions des présentes CGU, RISCO vous accorde un droit limité, non exclusif, non transférable, incessible, sans droit d’accorder une sous-licence, révocable, uniquement pendant la Durée, à titre personnel, d’accéder au Service et de l’utiliser à des fins personnelles et non commerciales, uniquement en conformité avec les présentes CGU, sous réserve des restrictions suivantes. Sauf dans les cas expressément autorisés par les présentes CGU et/ou toute Annexe applicable, vous vous abstiendrez (et n’autoriserez pas ni ne permettrez à un autre tiers), directement ou indirectement, de : (a) commercialiser, vendre, revendre, concéder sous licence, louer, utiliser à des fins commerciales, fournir ou mettre à la disposition d’un tiers, ou autrement de distribuer, héberger ou exploiter de toute autre manière, directement ou indirectement, tout Service ; (b) copier, modifier, altérer, dupliquer, décompiler, pratiquer l’ingénierie inverse, désassembler ou autrement tenter de découvrir le code source, le code objet ou la structure sous-jacente, les idées, le savoir-faire ou les algorithmes pertinents pour les Services (ou tout composant de ceux-ci) ou tout logiciel, toute documentation ou donnée liée aux Services (ou une partie de ceux-ci) ; sauf dans la mesure où l’application de la restriction ci-dessus est interdite par la loi applicable ; (c) copier ou reproduire tout contenu faisant partie des Services ; ou (d) accéder et utiliser les Services afin de (i) construire un produit ou des services concurrentiels, ou (ii) copier des idées, caractéristiques, fonctions ou graphiques des Services ; (e) modifier, traduire, créer des œuvres dérivées basées sur les Services (sauf dans la mesure expressément autorisée par RISCO ou autorisée dans le cadre des Services) ; (f) utiliser les Services de façon abusive en introduisant sciemment des virus, des chevaux de Troie, des vers, des bombes logiques ou tout autre matériel malveillant ou technologiquement nuisible (« Code Malveillant ») ; (g) tenter d’obtenir un accès non autorisé aux Services ou à tout serveur, ordinateur ou base de données connecté(e) aux Services ou attaquer les Services au moyen d’une attaque par déni de service ou d’une attaque par déni de service distribué ; (h) utiliser les Services pour xxxxxxx ou transmettre, enfreindre ou de toute autre ...

  • Competitive Supplier’s Standard Credit Policy The Competitive Supplier will not require a credit review for any consumer participating in the Program, nor does Competitive Supplier require any consumer to post any security deposit as a condition for participation in the Program. The Competitive Supplier may terminate service to a Participating Consumer and return such consumer to a Basic Service in the event that the Participating Consumer fails to pay to Competitive Supplier amounts past-due greater than sixty (60) days.

  • Purchase Order Flip via Ariba Network (AN) The online process allows suppliers to submit invoices via the AN for catalog and non- catalog goods and services. Contractors have the ability to create an invoice directly from their Inbox in their AN account by simply “flipping” the purchase order into an invoice. This option does not require any special software or technical capabilities. For the purposes of this section, the Contractor warrants and represents that it is authorized and empowered to and hereby grants the State and the third-party provider of MFMP the right and license to use, reproduce, transmit, distribute, and publicly display within the system the information outlined above. In addition, the Contractor warrants and represents that it is authorized and empowered to and hereby grants the State and the third-party provider the right and license to reproduce and display within the system the Contractor’s trademarks, system marks, logos, trade dress, or other branding designation that identifies the products made available by the Contractor under the Contract.

  • Shipping must be Freight On Board Destination to the delivery location designated on the Customer purchase order The Contractor will retain title and control of all goods until delivery is completed and the Customer has accepted the delivery. All risk of transportation and all related charges are the responsibility of the Contractor. The Customer will notify the Contractor and H-GAC promptly of any damaged goods and will assist the Contractor in arranging for inspection. The Contractor must file all claims for visible or concealed damage. Unless otherwise stated in the Agreement, deliveries must consist only of new and unused merchandise.

  • Network Services Local Access Services In lieu of any other rates and discounts, Customer will pay fixed monthly recurring local loop charges ranging from $1,200 to $2,000 for TDM-based DS-3 Network Services Local Access Services at 2 CLLI codes mutually agreed upon by Customer and Company.

  • Tandem Transit Traffic 12.1 As used in this Section, Tandem Transit Traffic is Telephone Exchange Service traffic that originates on CBB's network, and is transported through Verizon’s Tandem to the subtending End Office or its equivalent of another carrier (CLEC, ILEC other than Verizon, Commercial Mobile Radio Service (CMRS) carrier, or other LEC (“Other Carrier”). Neither the originating nor terminating customer is a Customer of Verizon. Subtending End Offices shall be determined in accordance with and as identified in the Local Exchange Routing Guide (LERG). Switched Exchange Access Service traffic is not Tandem Transit Traffic.

  • Conversion of Wholesale Services to Network Elements or Network Elements to Wholesale Services Upon request, BellSouth shall convert a wholesale service, or group of wholesale services, to the equivalent Network Element or Combination that is available to Global Dialtone pursuant to Section 251 of the Act and under this Agreement or convert a Network Element or Combination that is available to Global Dialtone pursuant to Section 251 of the Act and under this Agreement to an equivalent wholesale service or group of wholesale services offered by BellSouth (collectively “Conversion”). BellSouth shall charge the applicable nonrecurring switch-as-is rates for Conversions to specific Network Elements or Combinations found in Exhibit A. BellSouth shall also charge the same nonrecurring switch-as-is rates when converting from Network Elements or Combinations. Any rate change resulting from the Conversion will be effective as of the next billing cycle following BellSouth’s receipt of a complete and accurate Conversion request from Global Dialtone. A Conversion shall be considered termination for purposes of any volume and/or term commitments and/or grandfathered status between Global Dialtone and BellSouth. Any change from a wholesale service/group of wholesale services to a Network Element/Combination, or from a Network Element/Combination to a wholesale service/group of wholesale services, that requires a physical rearrangement will not be considered to be a Conversion for purposes of this Agreement. BellSouth will not require physical rearrangements if the Conversion can be completed through record changes only. Orders for Conversions will be handled in accordance with the guidelines set forth in the Ordering Guidelines and Processes and CLEC Information Packages as referenced in Sections 1.13.1 and 1.13.2 below.

  • CONSTRUCTION MANAGER’S SERVICES The services which the Construction Manager shall provide include, but are not limited to, those described or specified herein. The services described or specified shall not be deemed to constitute a comprehensive specification having the effect of excluding services not specifically mentioned.

  • Application Services Under an “Application Services” engagement, we will assist you with defining, developing and deploying end-to-end enterprise or departmental applications; tasks may include determining the optimal technology approach and caching strategy to deliver effective, high-performance applications; leveraging a best practice approach for building new applications which includes conducting user workshops, building wireframes, iterating, testing, documenting and mentoring to increase adoption; and enhancing, optimizing or redesigning existing applications for improved user experience, faster performance or extended functionality.

  • Extended Support Services As long as funding is available (through FFFS, etc.), the district will provide the following supportive services for individuals who are eligible under the TANF Services 200% of poverty eligibility guidelines: Services listed in the supportive services attachment are provided to TANF, SNAP and 200% eligible individuals.
