Once the professional employee has withdrawn 20 days from the sick leave bank, the professional employee shall be eligible to withdraw an additional 20 days, with committee approval. However, if the Firemen's Pension Fund provides that an employee may receive non-duty disability benefits under this Fund only if he is totally and permanently disabled, the employee who cannot for that reason qualify for benefits under the Fund will be entitled to use the full amount of the sick leave benefits he has then accumulated.

ADI ACKNOWLEDGES THAT MASIMO INTENDS TO USE THE DSP PRODUCTS IN PRODUCTS THAT HAVE THE PRIMARY FUNCTION OF NON-INVASIVELY MONITORING BLOOD AND/OR OTHER BODILY FLUID CONSTITUENTS (“MASIMO MONITORING PRODUCTS”). EXCEPT FOR MASIMO MONITORING PRODUCTS, IF MASIMO USES OR SELLS PRODUCTS FOR USE IN SUCH CRITICAL APPLICATIONS IDENTIFIED ABOVE, MASIMO WILL DO SO AT MASIMO’S OWN RISK AND MASIMO AGREES TO DEFEND, INDEMNIFY AND HOLD HARMLESS ADI FROM ANY AND ALL DAMAGES, CLAIMS, SUITS OR EXPENSES RESULTING FROM SUCH USE.
