Sick Leave Bank. The school corporation agrees to, and hereby establishes a voluntary sick leave bank to which certificated persons may contribute unused sick leave days, and from which a contributing individual may draw sick leave days when the individual’s annual and accumulated sick leave days are exhausted, in accordance with the following provisions. Please see the definitions of sick leave under Article IV.
1. The sick leave bank shall apply to all persons employed by the school corporation whose employment requires the holding of a license issued by the Indiana Department of Education, whether or not any such person is a member of the bargaining unit to which this contract applies.
2. A “contributing individual” is one who, within the first thirty (30) days of the contract year, signs a contribution form. Such contribution form shall require the assigning of one (1) day of sick leave to the sick leave bank and an individual may contribute up to five (5) total days if so motivated during any enrollment period.
3. A person shall cease to be a contributing individual upon the failure of such individual to sign such contribution form and such individual shall thereafter not be entitled to draw any sick leave days from the sick leave bank until becoming a contributing member the following year.
4. Present and new faculty members who wish to become “contributing individuals” may do so by following the procedure in paragraph two (2). Staff who hire in after the annual enrollment period closes can still enroll under equivalent timelines as original enrollment period.
5. Use of the sick leave bank shall be subject to the following limitations:
a. Sick bank leave shall be used on a teacher’s first day receiving no pay as long as the teacher has exhausted all accumulated sick days, as well as all annual sick and personal days. Days may need to be allotted retroactively to allow time for the sick bank committee to meet and review the request. In the event a teacher on sick bank leave returns to work and then finds it necessary on advice of a doctor to take additional leave for the same disability, no additional days shall be deducted subject to the approve of the Sick Bank Review Committee.
b. In the even a teacher is disabled as a result of illness or injury of a different nature during the same school year, any additional sick leave bank time granted is subject to approval of the Sick Bank Review Committee.

Sick Leave Bank. 1. Each Professional Employee of the District covered by the contract with the Association may participate in the Sick Leave Bank. To begin participation in any school year, a Professional Employee shall, prior to September 15, or within fifteen (15) days after signing a contract if not an employee by September 15 (hereafter described as "enrollment period"), contribute two (2) sick leave days. Each time the Sick Leave Bank falls below one hundred eighty (180) days, every participating member shall be assessed one (1) additional sick leave day. Sick leave days thus contributed shall be deducted from the individual's accumulated sick leave. The contributed sick leave days shall form a bank of sick leave days which will be available to all participating Professional Employees for absence from work necessitated by prolonged or recurring illness of the Professional Employee extending beyond the employee's available leave, as set out below. Eligible employees electing not to join during the initial enrollment period must wait until the enrollment period of the following year.
2. A Committee, including three (3) Professional Employees selected by the LEA and three (3) administrators selected by the Superintendent, establish such procedures necessary to implement and operate the Sick Leave Bank.
3. Application for use of the Sick Leave Bank shall be submitted to the Committee, which shall review the request and determine the eligibility of the Professional Employee. Proof of illness may be required at the time of application and from time to time after a grant has been made.
4. To be eligible for sick leave benefits from the Sick Leave Bank, the Professional Employee must:
(1) be a current Sick Leave Bank member and contributor to the Sick Leave Bank,
(2) have been absent from work due to accident or illness of the Professional Employee,
(3) have used all his/her accumulated sick leave days and personal leave days, and
(4) had two (2) days after exhaustion of accumulated sick leave and personal leave where his/her salary was reduced in full. Application must be on the form provided in the Appendix within fifteen (15) days of the depletion of sick leave. After complete review of the application, the Committee shall have the authority within the procedures to make final decisions as to the disposition of the case. Sick Leave Bank. A. The Sick Leave Bank will continue in effect.
B. Effective July 1, 1980, membership in the bank was voluntary for all employees. Thereafter, all new employees who request membership will be assessed one day of sick leave for deposit in the bank.
C. A member of the bargaining unit may participate in the bank only after:
1. Filing application with the Sick Leave Bank Committee;
2. Submitting satisfactory medical evidence of the illness;
3. Submitting evidence of having exhausted all accumulated leave;
4. Satisfying such other criteria as may be established by the joint committee which includes an evaluation of the teacher’s past sick leave usage record.
D. A joint committee of six (6) members, half named by the Board and half named by the Union, will administer the Sick Leave Bank and establish specific procedures for its utilization.
E. Any employee who contributed one day to the Sick Leave Bank shall not be charged a sick leave day for the purpose of sick leave conversion. The day will be drawn from the prior year’s accumulated sick leave, except in the event that the employee has no sick leave, in which case that day will be drawn from the current year.
F. New employees must join the Sick Leave Bank within the first thirty (30) days of their employment or lose their right to do so.
G. Employees may relinquish their membership in the sick leave bank at any time; if they do so, however, they will lose both their contribution in the Sick Leave Bank and their right to rejoin the bank at a later date.
H. A member will lose the right to utilize the Sick Leave Bank if his employment with the Baltimore City Public School System is terminated.
I. All contributions will remain in force and cannot be returned even upon cancellation of a membership. In no case will the granting of leave from the bank cause a member to receive more than his or her annual salary.
J. All unused sick leave days in the bank at the end of a school year shall be carried over to the next school year.
Sick Leave Bank. The Employer agrees to establish a sick leave bank to cover employee/s in the event of long term illness. The sick leave bank shall be administered by a committee composed of five (5) members of the Union appointed by the Union President. Rules for membership and participation in the sick leave bank shall be established by the committee and shall be supplied to the Employer. Any rules established by the committee shall include the following:
(A) The sick leave bank shall be funded by bargaining unit members at the start of each school year to reach a maximum two (2) times the number of staff members. The sick leave bank may be supplied with additional days whenever the number of days drops below fifty (50) to bring it up to the maximum.
(B) Unused sick leave days in the bank at the close of the school year will carry over into subsequent years up to a unit of two (2) times the number of staff.
(C) No one may contribute more than two (2) days in any school year to the sick leave bank; and that any days contributed shall be deducted from that year's sick leave entitlement for the person making said contribution. Bargaining unit members must have ten (10) days of accrued sick leave on file with the employer prior to donating to the Sick Leave Bank.
(D) The Union shall notify the Employer by September 15th of each year of the individuals who have donated days to the sick leave bank so that said days may be deducted from the individual's yearly entitlement.
(E) Individuals may not elect to receive sick leave benefits in lieu of disability benefits. Eligibility for sick leave bank benefits shall terminate when an individual is eligible for disability benefits.
(F) No one shall, under any circumstances, be entitled to receive sick leave and disability benefits at the same time.
(G) New employees are not eligible for sick bank participation prior to January 1st if they are hired before the first day of school and for 120 calendar days after employment if hired after the first day of school.
Sick Leave Bank. A voluntary sick leave bank shall be established whereby a certificated school employee, who is absent from assigned duties due to personal illness and who has utilized all sick leave, personal leave, and all other paid leave benefits of whatever nature may petition a committee, as established herein, for sick leave days from the bank under the following conditions:
A. The number of accumulated days in the bank shall not exceed one hundred seventy-five (175) days, provided, however, that (a) a veteran teacher who is not a current member of the bank may become a member by contributing one (1) sick leave day to the bank not earlier than August 1st nor later than September 15th of any school year, and (b) a teacher who is newly hired in this School Corporation shall have fifteen (15) days from the date of initial duty assignment, or until September 15th of any school year, whichever is later, during which time such teacher may choose to participate in the bank by contributing one
(1) sick leave day, even though such contribution by such veteran or newly hired teacher would cause an accumulation of days in excess of the maximum specified herein;
B. Said teacher may be granted days from the bank under the following conditions:
1. The teacher must have chosen to become a current member of and participate in such bank by contributing one (1) sick leave day to the bank not earlier than August 1st nor later than September 15th each year, and such day contributed shall be non-returnable to the teacher. However, in the event that the number of accumulated days in the bank at the beginning of a school year is of sufficient number that a contribution of one (1) sick leave day by all teachers who are current members of the bank would cause the maximum number of days specified hereinabove in Paragraph One (1) to be exceeded, the current year's contribution by all such current members shall be suspended, except that in case the bank is depleted during the school year, the current year's contribution shall be assessed at the time of such depletion;
2. The teacher must have utilized and exhausted all paid leave benefits of whatever nature, including said teacher's own accumulated sick leave and personal leave;
3. Written certification will be provided from said teacher's physician substantiating the illness and certifying that the absence will continue during a period of at least five (5) consecutive days following the utilization and exhaustion of all said paid leave benef...
Sick Leave Bank. When in the judgment of a bargaining unit member's physician and a yearly committee made up of two (2) ▇▇▇▇ appointed members, two (2) Board appointed members, and a mutually agreed upon fifth member to chair, the employee will exhaust all of his/her accumulated sick leave for the remainder of the school year due to catastrophic illness or injury of the bargaining unit member, which does not include pregnancy or childbirth unless there are catastrophic consequences to the mother, and additional days are still needed, then he/she may request through the Superintendent that additional days be transferred from other bargaining unit members' accumulated sick leave. The Association shall establish an internal policy to administer such a transfer. The Association shall notify the treasurer of the Board, in writing, of the number of days to be deducted, from whom, and the person receiving the transferred days. Included in the notice shall be a signed statement by the bargaining unit member involved authorizing the Board treasurer to transfer the days. The appropriateness of an application for disability retirement will be discussed with the affected member. These additional limitations will apply to this paragraph:
a. No teacher who begins the school year with less than forty-five (45) days as of July 1 can donate sick leave days.
b. Donations from a bargaining unit member must be in units of one (1) day, but no more than five (5) days total per recipient, provided that the donor not go below forty-five (45) days of accumulated sick leave.
c. The bargaining unit member to whom the days are given must personally have the catastrophic illness or injury.
d. If the bargaining unit member has applied for disability retirement, then the member can use the donated leave days until the disability retirement takes effect.
e. No more days can be given than needed by the bargaining unit member to serve out the regular school year, and only that school year.
f. The bargaining unit member must exhaust his/her own sick and personal leave first.
g. The bargaining unit member who is using donated sick leave will not earn additional sick leave while receiving the donated leave days.
h. A bargaining unit member's donation of sick leave to another bargaining unit member shall not count as use of sick leave for the purposes of calculating the non-use incentive payment.

Sick Leave Bank. If a member of the bargaining unit is absent due to a non-elective surgery or long-term illness or accident of the employee, or his/her family as defined in the Master Agreement (Article VIII Section A.1), has exhausted all of his/her accumulated sick leave, personal leave and vacation (where applicable), he/she may request a sick leave donation from the District's Sick Leave Bank. Participation in the Sick Leave Bank shall be voluntary.
1. Any employee may elect to participate in the Bank by contributing one (1) sick day (defined as the number of hours that the donating employee is scheduled to work in a day) to the Bank in order to join.
a. Bargaining unit members will receive a form with their first pay in September electing to participate in the Sick Leave Bank. Members must return the form to the Treasurer within ten (10) working days. New employees wishing to participate must notify the Treasurer within ten (10) working days after being officially employed by the Board.
b. Donated days will be deducted from the second pay period in October.
c. Once a bargaining unit member donated sick leave to the bank, the donation is irrevocable. The sick leave donation shall be immediately deducted from the bargaining unit member who donated the sick leave and placed into the Sick Leave Bank.
2. Requests for donation of sick leave must be approved by the Sick Leave Bank Committee, comprised of the Superintendent/Designee, Treasurer/Designee, Union President/Designee, and two (2) bargaining unit members appointed by the Union President. The committee's decision shall be final and not subject to the grievance procedure.
a. Donations may only be approved for non-elective surgery or long-term illnesses or injuries and may not extend beyond a maximum period of thirty (30) work days.
b. Sick leave bank days will be granted only in cases of absence that comply with the language of the Master Agreement for sick leave usage.
c. Recuperation from surgeries or other procedures, which could have otherwise reasonably been scheduled during school vacation periods, will not qualify for Sick Leave Bank donation.
d. Sick Leave Bank members must use accumulated sick leave, personal leave and vacation first and then may use days from the sick leave bank if needed. A withdrawal may be approved only upon the depletion of the respective employee's accumulated sick leave.

Sick Leave Bank. A. Teachers on active duty in ▇▇▇▇▇▇ County are eligible to contribute to a sick leave bank. Contributors will be permitted to apply for leave from the bank to cover regularly scheduled duty days for periods of personal illness, injury, or quarantine which are not only prolonged but are also catastrophic and incapacitating and which are not likely to permanently disable the teacher. New members of the sick leave bank may not access the bank until a 60 school-day waiting period has been met.
B. The contribution on the appropriate form will be authorized by the teacher and continued from year to year until canceled in writing by the member. Cancellation, on the proper form, may be elected at any time, and the member shall not be eligible to use the bank as of the effective cancellation date. Sick leave properly authorized for contribution to the bank will not be returned if the member effects cancellation.
C. Enrollment Period - The annual enrollment period shall be from July 1 to October 31. Teachers returning from an extended leave of absence and new teachers may contribute within thirty (30) calendar days upon reassignment or employment. Teachers returning from extended sick leave shall be permitted to contribute to the bank upon approval of the committee.
D. Annual rates of contribution shall be a maximum of one (1) day per year as determined by the Association and certified to the Superintendent prior to July 1 of each year.
E. The maximum number of sick days that can be granted in any one fiscal year will be the remaining number of duty days a teacher is scheduled to work. In no case will the granting of leave from the bank cause a teacher to receive more than his annual salary.
F. Teachers must use all accumulated sick leave and all but two (2) days of accumulated personal leave before receiving leave from the bank. Application for use of the bank shall be made on the required form and submitted to the approval committee.
G. A four-member approval committee, comprised of three members appointed by the president of the Association, and one member appointed by the superintendent, shall have the responsibility of receiving requests, verifying the validity of requests, recommending approval or denial of the requests, and communicating its decision to the teacher and the Superintendent/designee. Sick Leave Bank. The purpose of the Sick Leave Bank is to relieve its members from undue financial burden due to absence from work on a long-term basis due to illness, injury or incapacitation of sufficient severity to make their presence at school medically inadvisable.
Sick Leave Bank. By mutual agreement of the Superintendent and Association Sick Bank Committee (herein ASBC), Employees periodically will be asked to voluntarily transfer one (1) day of their accumulated sick leave to a special sick leave bank to be administered by the Association in accordance with the following:
1. Withdrawal of days from the sick leave bank shall be for serious illness on the part of the Employee or family member living within the household only. It shall not be applicable to any disability of the Employee or family member living within the household related to maternity leave (with the exception of serious complications that threaten the safety of the mother and/or child), or medical procedures which could safely be deferred until a vacation, recess, or other non- work day(s) or hour(s).
2. In order for a participating Employee to withdraw from the Sick Leave Bank, a period of five (5) workdays must pass following the exhaustion of the Employee’s accumulated sick leave. Once this condition has been met, the Employee may make application to utilize days from the Sick Leave Bank in full-day units. Such request shall be submitted in writing to the ASBC with a copy given to the Superintendent and shall be accompanied by a doctor’s verification as proof of need.
3. Within five (5) workdays after receipt of the request, the ASBC shall determine if the requested day(s) should be approved, provided there are sufficient days available in the Sick Leave Bank.
4. If the requested day(s) from the Sick Leave Bank are approved, the ASBC will notify the Superintendent in writing of the name of the Employee and the number of days that are approved from the Sick Leave Bank. The Employee submitting such request will be advised, in writing, by the Association if the requested days are approved or are not approved. A copy of this notice will be given to the Superintendent.
