Common use of Unsuitable Material Clause in Contracts

Unsuitable Material. Dredged sediment that has been tested and determined by the DMMO to be Not suitable for Unconfined Aquatic Disposal (NUAD). This unsuitable material may be disposed at permitted beneficial reuse sites such as Montezuma Wetlands Project or at an approved upland landfill facility. Actual disposal site shall be designated by Port. Alternate sites for beneficial reuse of the material may also be approved by the Port.
