Common use of Unlawful Use of Service Clause in Contracts

Unlawful Use of Service. Services, facilities or unbundled elements provided by GTE pursuant to this Agreement shall not be used by DTI or its end users for any purpose in violation of law. DTI, and not GTE, shall be responsible to ensure that DTI and its end users use of services, facilities or unbundled elements provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to DTI or disconnect particular services, facilities or unbundled elements provided under this Agreement to DTI or, as appropriate, DTI's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service, facilities or unbundled elements is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to DTI, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of DTI and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

DTI, and not GTE, shall not be responsible to ensure that DTI ACI and its end users use of services, facilities or unbundled elements provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to DTI ACI or disconnect particular services, facilities or unbundled elements provided under this Agreement to DTI ACI or, as appropriate, DTIACI's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service, facilities or unbundled elements is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to DTIACI, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of DTI ACI and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

DTIHyperion, and not GTE, shall be responsible to ensure that DTI Hyperion and its end users use of services, facilities or unbundled elements provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to DTI Hyperion or disconnect particular services, facilities or unbundled elements provided under this Agreement to DTI Hyperion or, as appropriate, DTI's Hyperion’s end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service, facilities or unbundled elements is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to DTIHyperion, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of DTI Hyperion and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GTE may refuse to furnish service to DTI QTC or disconnect particular services, facilities or unbundled elements provided under this Agreement to DTI QTC or, as appropriate, DTIQTC's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service, facilities or unbundled elements is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to DTIQTC, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of DTI QTC and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GTE may refuse to furnish service to DTI USX or disconnect particular services, facilities or unbundled elements provided under this Agreement to DTI USX or, as appropriate, DTI's USX’s end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service, facilities or unbundled elements is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to DTIUSX, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of DTI USX and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

DTINAS, and not GTE, shall be responsible to ensure that DTI NAS and its end end-users use of services, facilities or unbundled elements provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to DTI NAS or disconnect particular services, facilities or unbundled elements provided under this Agreement to DTI NAS or, as appropriate, DTINAS's end end-user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service, facilities or unbundled elements is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to DTINAS, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of DTI NAS and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GTE may refuse to furnish service to DTI SETI or disconnect particular services, facilities or unbundled elements provided under this Agreement to DTI SETI or, as appropriate, DTISETI's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service, facilities or unbundled elements is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to DTISETI, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of DTI SETI and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GTE may refuse to furnish service to DTI XXX or may disconnect particular services, facilities or unbundled elements provided under this Agreement to DTI XXX or, as appropriate, DTIELI's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service, facilities or unbundled elements is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to DTIXXX, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of DTI XXX and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GTE may refuse to furnish service to DTI SMOKESIGNAL or disconnect particular services, facilities or unbundled elements services provided under this Agreement to DTI SMOKESIGNAL or, as appropriate, DTISMOKESIGNAL's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service, facilities or unbundled elements service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to DTISMOKESIGNAL, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of DTI SMOKESIGNAL and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.
