Common use of Unlawful Use of Service Clause in Contracts

Unlawful Use of Service. Services provided by GTE pursuant to this Agreement shall not be used by EZ Talk or its end users for any purpose in violation of law. EZ Talk, and not GTE, shall be responsible to ensure that EZ Talk and its end users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to EZ Talk or disconnect particular services provided under this Agreement to EZ Talk or, as appropriate, EZ Talk's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to EZ Talk, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of EZ Talk and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

EZ TalkUSTELCOM, and not GTE, shall be responsible to ensure that EZ Talk USTELCOM and its end users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to EZ Talk USTELCOM or disconnect particular services provided under this Agreement to EZ Talk USTELCOM or, as appropriate, EZ TalkUSTELCOM's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to EZ TalkUSTELCOM, or as ordered by the court. Termination of service shall take place after reasonable notice is provided to EZ TalkFirst Choice, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of EZ Talk First Choice and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

Termination of service shall take place after reasonable notice is provided to EZ TalkNOW, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of EZ Talk NOW and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

EZ TalkCCI, and not GTE, shall be responsible to ensure that EZ Talk CCI and its end users customers’ use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to EZ Talk CCI or disconnect particular services provided under this Agreement to EZ Talk CCI or, as appropriate, EZ TalkCCI's end user customer when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to EZ TalkCCI, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of EZ Talk CCI and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GTE may refuse to furnish service to EZ Talk Prepaid or disconnect particular services provided under this Agreement to EZ Talk Prepaid or, as appropriate, EZ TalkPrepaid's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to EZ TalkPrepaid, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of EZ Talk Prepaid and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GTE may refuse to furnish service to EZ Talk PCS or disconnect particular services provided under this Agreement to EZ Talk PCS or, as appropriate, EZ TalkPCS's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to EZ TalkPCS, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of EZ Talk PCS and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GTE may refuse to furnish service to EZ Talk dPi or disconnect particular services provided under this Agreement to EZ Talk dPi or, as appropriate, EZ TalkdPi's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to EZ TalkdPi, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of EZ Talk dPi and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of EZ Talk eti and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GTE may refuse to furnish service to EZ Talk USA Digital or disconnect particular services provided under this Agreement to EZ Talk USA Digital or, as appropriate, EZ TalkUSA Digital's end user customer when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to EZ TalkUSA Digital, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of EZ Talk USA Digital and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GTE may refuse to furnish service to EZ Talk GSCOMM or disconnect particular services provided under this Agreement to EZ Talk GSCOMM or, as appropriate, EZ TalkGSCOMM's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to EZ TalkGSCOMM, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of EZ Talk GSCOMM and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GTE may refuse to furnish service to EZ Talk JTC or disconnect particular services provided under this Agreement to EZ Talk JTC or, as appropriate, EZ TalkJTC's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to EZ TalkJTC, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of EZ Talk JTC and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.
