Common use of Understudies Clause in Contracts

Understudies. (A) All roles except “bit parts” shall be covered by understudies. Understudies shall be engaged no later than one week prior to the first public performance. Such understudies may be nonprofessionals. Each such nonprofessional understudy shall file with Equity a Nonprofessional Registration Form (provided by Equity) upon joining the production. No Actor may be assigned more than four understudy assignments in one production. The Producer shall submit a list of all understudy assignments prior to the first paid public performance. (B) An understudy assignment made to a contracted Actor who is performing in the production shall be listed on the original contract, or in a rider added to the contract stating the appropriate salary adjustments. (See Rule 58(I), SALARIES.) (C) Understudies who are not performing members of the company shall be paid no less than the applicable minimum salary for Actors. (See Rule 58(I), SALARIES.) (D) No Understudy shall be required to perform until one week after the Actor is engaged or assigned as Understudy, has had the script and/or music for one week and has had at least one rehearsal of all relevant scenes, blocking and costume changes in actual time. If the above conditions have not been met, the Understudy shall read the part or may perform if able and willing. (E) All Understudies to Principal Actors shall be listed in the program by name and role understudied. The listing shall be automatic unless an Understudy requests in writing that it be omitted. Copies of such requests shall be sent to the Producer and Equity. (F) See Rule 49(C), PROGRAMS, HOUSE BOARDS, CHANGES IN CAST, AND BILLING for the announcement of an Understudy performance. (G) If in an emergency an Actor performs a part not specified in said Actor's contract, the Actor shall be compensated for such performance at not less than double the pro rata rate of the Actor's contractual salary, and shall thereafter be contracted and compensated for such understudy duty at no less than the applicable prevailing minimum rate, subject to two week termination of the understudy assignment only. (H) If a nonprofessional is understudying an Actor, the nonprofessional may actually perform the role for a period of not more than two consecutive weeks. Thereafter, a contracted Actor shall fill the role. However, this replacement shall not diminish the original Actor's right to return to the role under his original contract, provided such contract has not been terminated (I) Any loss of performance due to the failure of the Producer to engage, employ or prepare an understudy shall be the sole liability of the Producer regardless of the reason that causes any Actor's absence.

Understudies. A PROFESSIONAL CHORISTER who is chosen to cover the solo role of another PROFESSIONAL CHORISTER or the solo role of an artist who is not a PROFESSIONAL CHORISTER is a Rehearsal Understudy. SYMPHONY will notify Rehearsal Understudies if any coachings for such roles will be made available and whether or not they may be required to sing at an open rehearsal in advance of such rehearsal. a) Covering a closed rehearsal SYMPHONY shall compensate each PROFESSIONAL CHORISTER one (A1) All roles except “bit parts” shall be covered by understudies. Understudies shall be engaged no later hour of additional Rehearsal Pay for each rehearsal in which they perform the role as Rehearsal Understudy, but not less than one week prior (1) additional Performance pay per program. b) Covering an open rehearsal In the event a PROFESSIONAL CHORISTER performs the role of Rehearsal Understudy in an open rehearsal, SYMPHONY shall compensate each PROFESSIONAL CHORISTER fifty percent (50%) the applicable Solo Fee as though it were a performance as set forth in Article 9.3.b above, in addition to the first public performanceapplicable fees paid to such Rehearsal Understudies as defined in Article 9.5.a above. Such understudies may SYMPHONY shall give Rehearsal Understudies at least seven (7) days’ notice of material to be nonprofessionals.
