Common use of Unbundled Interoffice Facilities Clause in Contracts

Unbundled Interoffice Facilities. Subject to Section 11.7, where facilities are available, at Mpower’s request, BA shall provide Mpower with interoffice transmission facilities ("IOF") unbundled from other Network Elements in accordance with but only to the extent required by Applicable Law, at the rates set forth in Exhibit A and in BA's applicable Tariffs, if any, as amended from time to time and in accordance with Section 20; provided, however, that BA shall offer unbundled shared IOF only to the extent that Mpower also purchases unbundled local switching capability from BA in accordance with Section 11.4 of this Agreement.
