TOP. HEAVY MINIMUM CONTRIBUTION Each Plan Year for which the Plan is Top Heavy under Code Section 416, each non-key Employee shall receive an allocation of Employer contributions equal to the lesser of 3% of Compensation or the percentage of Compensation allocated to the Key Employee receiving the highest percentage allocation. The Top-Heavy minimum contribution shall be satisfied under this Plan unless the Employer designates another plan in the Adoption Agreement. 7.2
