Common use of Tobacco Smoke Clause in Contracts

Tobacco Smoke. Notwithstanding section 12.1, the Tribe agrees to provide a non-smoking area in the Gaming Facility and to utilize a ventilation system throughout the Gaming Facility that exhausts tobacco smoke to the extent reasonably feasible under state-of-the-art technology existing as of the date of the construction or significant renovation of the Gaming Facility, and further agrees not to offer or sell tobacco products, including but not limited to smokeless tobacco products or e-cigarettes, to anyone younger than the minimum age specified in state law to lawfully purchase tobacco products.

Tobacco Smoke. Notwithstanding section 12.1, the Tribe agrees to where reasonable and feasible after consideration of engineering, economic and scientific factors and consistent with business needs shall provide a non-smoking area in the Gaming Facility and to utilize a ventilation system throughout the Gaming Facility that exhausts tobacco smoke to the extent reasonably feasible under state-of-the-art technology existing as of the date of the construction or significant renovation of the Gaming Facility, and further agrees not to offer or sell tobacco products, including but not limited to smokeless tobacco products or e-cigarettes, to anyone younger than the minimum age specified in state State law to lawfully legally purchase tobacco products.

Tobacco Smoke. Notwithstanding section 12.1, the Tribe agrees to provide a non-smoking area in the Gaming Facility and to utilize a Facility. If, after the effective date of this Compact, the Tribe significantly renovates or expands its existing Gaming Facility, the Tribe shall use the best available ventilation system throughout technology for the portion of the Gaming Facility that exhausts tobacco smoke to be renovated or expanded, and shall use the best available ventilation technology in the construction of a new Gaming Facility. The Tribe shall comply with all applicable federal laws with respect to the extent reasonably feasible under state-of-the-art technology existing as sale of the date of the construction or significant renovation of the Gaming Facility, and further agrees not to offer or sell tobacco products, including but not limited to smokeless tobacco products or e-cigarettes, to anyone younger than the minimum age specified in state law to lawfully purchase tobacco products.
