Common use of Title to Trust Property Clause in Contracts

Title to Trust Property. (a) Subject to the Indenture, title to all of the Trust Estate shall be vested at all times in the Trust as a separate legal entity until this Agreement terminates pursuant to Article VIII hereof; provided, however, that if the laws of any jurisdiction require that title to any part of the Trust Estate be vested in the trustee of the Trust, then title to that part of the Trust Estate shall be deemed to be vested in the Owner Trustee or any co-trustee or separate trustee, as the case may be, appointed pursuant to Article IX of this Agreement.

Title to Trust Property. (a) Subject to the Indenture, title to all of the Trust Estate Fund shall be vested at all times in the Trust as a separate legal entity until this Agreement terminates pursuant to Article VIII hereof; provided, however, that if the laws of any jurisdiction require that title to any part of the Trust Estate Fund be vested in the trustee of the Trust, then title to that part of the Trust Estate Fund shall be deemed to be vested in the Owner Trustee or any co-trustee or separate trustee, as the case may be, appointed pursuant to Article IX of this Agreement; provided, further, that title to any property may be transferred to the Indenture Trustee for purposes of securing the lien created under the Indenture.

(a) Subject to the Indenture, Legal title to all of the Trust Estate Property shall be vested at all times in the Trust as a separate legal entity until this Agreement terminates pursuant to Article VIII hereofentity; provided, however, that if the laws of where applicable law in any jurisdiction require that requires title to any part of the such Trust Estate Property to be vested in the trustee of the Trusta trustee, then title to that part of the Trust Estate shall be deemed to be vested in (i) the Owner Trustee (subject in all cases to Section 4.10), or any (ii) a co-trustee or separate trustee, as the case may be, Trustee appointed pursuant to Article IX under Section 7.2 of this Agreement.

(a) Subject Until this Agreement terminates pursuant to the IndentureSection 7.05 hereof, title to all of the Trust Estate Property shall be vested at all times in the Trust as a separate legal entity until this Agreement terminates pursuant to Article VIII hereofTrust; provided, however, that if the laws of any jurisdiction require that title to any part of the Trust Estate Property be vested in the trustee of the Trust, then then, subject to the prior written consent of the Trustee, title to that part of the Trust Estate Property shall be deemed to be vested in the Owner Trustee or any co-trustee or separate trustee, as the case may be, appointed pursuant to Article IX VII of this Agreement.
