Upon written notice (a “Notice of Default”) providing adequate identification of Developer’s failure to comply with any material term or condition of this Agreement (a “Default”), which must be provided in accordance with Article XVII. Notice of this Agreement, the City and/or the Board shall have the right to terminate this Agreement for cause, in whole or in part, if Developer fails to: cure such Default within any applicable notice and cure period.
