Common use of Termination Due to Executive’s Death Clause in Contracts

Termination Due to Executive’s Death. This Agreement and Executive’s employment hereunder will terminate immediately upon Executive’s death and the Company shall not have any further liability or obligation to Executive, Executive’s executors, heirs, assigns or any other person claiming under or through Executive’s estate, except that Executive’s estate shall receive payment for all Accrued Obligations and Termination Compensation as if Executive had been terminated by the Company without Cause.

This Agreement and If Executive dies during Executive’s employment hereunder will terminate with the Company, the Company’s obligations under this Agreement shall immediately upon expire, except that on the next regular payday following Executive’s death and the Company shall not have any further liability or obligation to Executive, pay Executive’s executors, heirs, assigns estate (or other lawful successor) that portion of Executive’s Base Salary earned and any other person claiming under or accrued benefits vested through the date of Executive’s death. The Company shall have no further obligations to Executive and to Executive’s estate, except that Executive’s estate shall receive payment for all Accrued Obligations heirs, executors, administrators, and Termination Compensation as if Executive had been terminated by the Company without Causepersonal representatives under this Agreement.
