Tender of Project Area. Upon issuance to the Developer or its contractor of an FDOT or County construction permit, project areas for the Roadway Improvements shall be deemed to be tendered to the Developer or its contractor, as applicable, and such entity shall be in custody and control of the project areas. The Developer or its contractor shall be responsible for providing a safe work zone for the public.
