Upon the commencement of construction, the X.X. 00 Xxxxxxxxx xxxx and the Eastern Segment shall be deemed to be tendered to the DEVELOPER, and the DEVELOPER shall be in custody and control of the improvements area. The DEVELOPER shall be responsible for providing a safe work zone for the public.
