Common use of Temporary Disability Clause in Contracts

Temporary Disability. WORKERS’ COMPENSATION (IOD) Section I Management agrees to adhere to the City’s policies with regard to the Citywide Temporary Modified Duty (Return to Work) Program. During the term of this MOU, Management agrees to continue providing Workers' Compensation benefits in accordance with LAAC Section 4.104, except that salary continuation payments during absences for temporary disabilities arising from job-related injuries or illnesses (injury on duty [IOD]) shall be in an amount equal to the employee's regular biweekly, take-home pay at the time of incurring the disability condition. For the purposes of this Article, take-home pay is defined as an employee's biweekly gross salary rate less the mandatory deductions for Federal and State income tax withholding, and employee retirement contributions.
