SURPLUS TRANSFER. Should an employee’s job be declared surplus, the Company will make every effort to place such employees in a classification carrying a comparative wage rate. If this cannot be done, such employees, will be red circled at the former classification wage rate or subject to possession of necessary skills, ability and seniority, shall be entitled to exercise bumping privileges as per Article An employee who exercises bumping privileges into a lesser skilled classification will receive the wage rate of that classification. Employees who are deemed by the Company to be unsuccessful in their Apprenticeship for Skilled positions will be subject to the following procedure: If they are fully qualified in another classification, they will be transferred back to that classification. If they are not fully qualified, they will be transferred to the classification of Skilled Trades Assistant. Such employees shall not be allowed to remain in this classificationfor a period of more than six (6) months without the mutual agreement of both parties. If such employee has not successfully posted out of the position within six (6) months of transfer, they will be subject to the Surplus Transfer provisions of this agreement. The hourly wage rate will reflect the percentage rate the employee maintained prior to the transfer with the comparator becoming the Heavy Line Truck Operator. The Parties further agree that this rate will not be less than of the Heavy Line Truck Operator rate. It is understood and agreed that employees shall only be allowed to access the provisions in this clause once within the course of their employment. Employees who are deemed by the Company to be unsuccessful in their Apprenticeship for a Heavy Line Truck Operator shall be transferred to the Light Line Truck Operator classification. It is understood and agreed that the classifications of Light Line Truck Operator and Skilled Trades Assistant shall only be occupied through the mechanisms noted herein and are not intended to be filled through normaljob

An employee who exercises bumping privileges into a lesser non-skilled classification will receive the wage rate of the employee they replaced plus fifteen cents per hour for the first year, ten cents per hour for the second year, five cents per hour for the third year and thereafter the classification rate. It is expressly understood that classificationno such employee will, by the application of this formula, be entitled to receive more than their former wage rate. Training credits may be granted to an Improver for previous training or experience in the work of the classification to which they are assigned for training at the beginning of the improvership. Employees assigned to new classifications in accordance with this clause have a probation period of thirty days worked wherein they may elect to revert to their former classification, but nothing in this clause will prevent their to their former classification, with respect to a skilled employee within ninety days worked and with respect to a semi-skilled employee within forty-five days worked, if, in the opinion of Management Personnel, they unlikely to perform their new duties acceptably. Affected skilled classifications are: Leader Lineman, Sub ▇▇▇▇▇▇▇ Underground, Site, Stores, Troubleman, Relief Troubleman, Leader Meter Repair, Leader, Will identify the Joint Apprenticeship Training in the Employee Information Book. Learners and Improvers are now deemed to be equivalent. Where have been absent due to illness, leave of absence or through injury covered by the Workers’ Compensation Act they shall be required, before they are rated as a skilled or semi-skilled employee, to serve all time thus lost, less a credit equivalent to their Annual Sick Leave Grant as provided under Article Sick Leave. This would be a maximum of eighteen working days in any one year training period will be necessaryperiod. Employees who are deemed by the Company to be unsuccessful in their Apprenticeship for Skilled positions will be subject to the following procedure: If they are fully qualified in another classification, they will be transferred back to that classification. If they are not fully qualified, they will be transferred to the classification of Skilled Trades Assistant. Such employees shall not be allowed to remain in this classificationfor a period of more than six (6) months without the mutual agreement of both parties. The hourly wage rate will reflect the percentage rate the employee maintained prior to the transfer technological changes in procedures if any other employment with the comparator becoming the Heavy Line Truck Operator. The Parties further agree that this rate will not be less than of the Heavy Line Truck Operator rate. It Commission for such member is available, and it is expressly understood and agreed that Management will discuss with the Union any such contemplated reduction in staff prior to such reduction becoming effective. Should it become necessary to reduce the workforce within a classification within a Division, employees shall only be allowed laid off in reverse order to access Divisional seniority and any employee so affected shall then exercise his or her seniority in the provisions following manner: Within any classification, within any Division for which they are qualified and in which junior employees are working. For purposes of this clause once within the course of their employmentimprovers are deemed to be in a separate classification from journeymen. Employees who are deemed by have been laid off within the Company to be unsuccessful in their Apprenticeship for a Heavy Line Truck Operator Division shall be transferred recalled in order of seniority and may be eligible to till a vacancy in a classification than their former position provided they have the Light Line Truck Operator necessary qualifications. Still the employee may be required to serve a period of one month upon return and may, subsequent to acceptance in the position, be required to upgrade their skills in the new classification. It is understood and agreed that the classifications of Light Line Truck Operator and Skilled Trades Assistant shall only be occupied through the mechanisms noted herein and are not intended to be filled through normaljob.
