Common use of Successors and Assigns; Third Parties Clause in Contracts

Successors and Assigns; Third Parties. This Agreement is intended to bind and inure to the benefit of the Parties, the Agents and their respective successors and permitted assigns, as applicable. There are no third party beneficiaries under this Agreement, and the rights or obligations of any Party under this Agreement may not be assigned, delegated, or transferred to any other person or entity; provided that any Lender under the Brava Credit Agreement from time to time that becomes a party to the Plan Support Agreement by execution of a Transfer Agreement or Joinder Agreement (as such terms are defined in the Plan Support Agreement) pursuant to Section 6 of the Plan Support Agreement, shall automatically become party to and be bound by the terms and conditions of this Agreement.5
