Common use of Substitute Performance Clause in Contracts

Substitute Performance. If Lessor fails to perform any material obligation of Lessor under this Agreement within thirty (30) days after written notice from Lessee describing the performance in reasonable detail, which notice shall not be sent until after the due date for such performance, then Lessee shall have the right to perform the obligation at the cost of Lessor, and Lessor shall pay Lessee the reasonable cost of such performance within thirty (30) days after Lessor’s receipt of an invoice for the same and reasonable supporting documentation.‌
