Common use of Subsequent Agreement Clause in Contracts

Subsequent Agreement. Notwithstanding the foregoing, in the event that the Company and Executive separately agree in writing after the date hereof (including, without limitation, in any equity award agreement) to restrictive covenants, including covenants relating to non-competition, non-solicitation and/or confidentiality, such covenants will automatically (without any further action by the parties hereto) supersede and replace the corresponding covenants set forth in this Section 5, except to the extent otherwise specifically provided otherwise in such separate agreement.
