SUBPOENAED AS A WITNESS. When a Unit member is subpoenaed as a witness by a court of competent jurisdiction, he/she shall be compensated in accordance with LAAC Section 4.111.1 (Payment of Salary When Subpoenaed as a Witness).
SUBPOENAED AS A WITNESS. Whenever any employee of this Department has been subpoenaed as a witness by a court of competent jurisdiction in connection with a matter arising out of the course of his/her employment with the Department and is required to respond to such subpoena on a scheduled day off, said employee shall be guaranteed two (2) hours for reporting and after two (2) hours he/she shall be paid to the next highest one-tenth (1/10) per hour that he/she was required to be in attendance at the hearing at the rate of time and a half (1- 1/2).
SUBPOENAED AS A WITNESS. A. Whenever an employee is served with a subpoena by a court of competent jurisdiction which compels his/her presence as a witness during his/her normal working period, unless he/she is a party to the litigation or an expert witness, such employee shall be granted time off with pay in the amount of the difference between the employee's regular earnings and any amount he/she receives for such appearance. This Article is not applicable to appearances for which the employee receives compensation in excess of his/her regular earnings.

The Company will pay an employee who has been subpoenaed as a witness, in a court of law or before a governmental agency and to which the Company has no detrimental interest, eight (8) hours pay per day at his regular straight time hourly rate less any payments received for services as a witness.

The Company will pay to a Dependent Contractor who has been subpoenaed as a witness in a court of law or before a governmental agency, resulting from an occurrence while performing work for the Company and to which the Company has no detrimental interest, the rate of pay stipulated in Schedule “A” less any payments received for services as a witness.

Approved leave of absence, i.e., emergency leaves, personal leaves, and mini-leaves. This excludes employees who are already being compensated for time out that encompasses the holiday under Sickness & Accident benefits or Workers Compensation insurance. 9. Any granted weather amnesty. The eligibility provisions of this Section are not applicable to the Paid Personal Days specified in Section 1. of this Article. It is understood that reasonable proof in the form of physicians' certificates, legal documents, letters on formal stationery, newspaper reports, or other mutually agreeable items, must be presented to the Company in the event of such absences. Individual hardship cases not provided for above may be brought to the attention of the Company by the Union.
