Subparagraph 3 Clause Samples

Subparagraph 3. 2 of Exhibit A of the Agreement is hereby amended to read as follows:

Subparagraph 3. 1.2 of paragraph 3 (Coming into force) will be amended as follows: (a) After the words "as soon as practicable" in subparagraph (b)(ii) there will be added ", unless subparagraph (iii) below applies". (b) At the end of subparagraph (b)(ii) the word "and" will be deleted. (c) A new subparagraph (b)(iii) will be inserted after subparagraph (b)(ii), the text of which will be:

Subparagraph 3 a. of the Agreement is hereby deleted in its entirety and replaced with the following new subparagraph 3.a.: a. The settlement of the sale of the Property in accordance with this Agreement (the "Settlement" or "Settlement Date") shall take place on a date mutually agreed upon by the parties, provided that the Settlement shall occur no later than March 9, 2018, unless extended to meet the conditions and requirements of paragraph 5 (Title), paragraph 10 (Hazardous Materials), paragraph 11 (Survey), or as provided in paragraph 3.b.”
