Statements Concerning the Company and Executive. 6.1Statements by Executive. Executive shall refrain, other than in the good faith performance of his duties to the Company, both during and after the termination of the employment relationship, from publishing any oral or written statements about the Company, any of its Affiliates or any of the Company’s or such Affiliates’ directors, officers or employees that (a) are slanderous, libelous or defamatory, (b) except as provided in Section 5.3, disclose Confidential Information of the Company, any of its Affiliates or any of the Company’s or any such Affiliates’ business affairs, directors, officers or employees, or (c) place the Company, any of its Affiliates, or any of the Company’s or any such Affiliates’ directors, officers or employees in a false light before the public. A violation or threatened violation of this prohibition may be enjoined by the courts and would be considered a material breach of this Agreement. The rights afforded the Company and its Affiliates under this provision are in addition to any and all rights and remedies otherwise afforded by law.
