SPLICING. 10.1 IRU Fibers may be physically spliced into the Owner’s Cable. Splicing requires penetration of the Cable sheath, exposing the Fibers within the sheath. In order to maintain the integrity of the Owner’s Cable after Acceptance, the Owner, or a contractor operating under the Owner’s direction, must perform all splicing performed on the Owner’s Cable. 10.2 For future expansion at existing splice points, the Owner will perform the necessary splicing upon written or email request by the IRU Grantee. Normal requests for splicing shall be submitted at least thirty (30) business days prior to the requested splicing date, and expedited requests shall be submitted at least 72 hours prior to the requested splicing date. The Owner shall obtain any and all permits necessary for such splicing. The IRU Grantee agrees that it will not perform any splicing or interfere in any manner with the Owner’s Cable. After Acceptance, the cost of splicing Fibers into the Owner’s Cable will be borne by the IRU Grantee. The Optical Splice Points for each route shall be mutually agreed upon in writing by the parties. The Owner shall provide the IRU Grantee with a splicing and splice testing schedule(s) so the IRU Grantee’s representative may be present, subject to protocols of Rights-of-Way agreements. Splicing documentation (ATP and test results) will be provided by US Xchange within ninety (90) days after splicing is completed. 10.3 The IRU Grantee shall provide thirty (30) days written notification to the Owner if a new splice point is needed after initial Acceptance of a Segment. 10.4 All splicing will be performed by the fusion splicing method or by any other method that is mutually agreeable.

In order to maintain the integrity of Owner’s Cable after Joint Acceptance, the Owner, or a contractor operating under Owner’s direction, must perform all splicing performed on the Owner’s Cable. 10.2 For future expansion at existing splice points, Owner will perform the necessary splicing upon written or email request by IRU Grantee. Normal requests for splicing shall be submitted at least ten (10) days prior to the requested splicing date, and expedited requests shall be submitted at least 72 hours prior to the requested splicing date. Owner shall obtain any and all permits necessary for such splicing. IRU Grantee agrees that it will not perform any splicing or interfere in any manner with the Owner’s Cable. After Joint Acceptance, the cost of splicing Fibers into Owner’s Cable will be borne by the IRU Grantee. The Optical Splice Points for each route shall be included in the engineered drawings which are subject to the review/approval procedure in Article 4.
SPLICING. 8.1 The Town may require that Additional Fibers be spliced into the Operator Cable. In order to maintain the integrity of the Operator Cable, the Operator, or a contractor operating under the Operator’s direction, must perform all splicing performed on the Operator Cable. 8.2 For future expansion at existing splice points, the Operator will perform the necessary splicing upon written or email request by the Town. Normal requests for splicing shall be submitted at least thirty (30) business days prior to the requested splicing date, and expedited requests shall be submitted at least fifteen (15) business days prior to the requested splicing date. The Town agrees that it will not perform any splicing or interfere in any manner with the Operator Cable. The cost of splicing Fibers into the Operator Cable will be borne by the Town. The Optical Splice Points for each route shall be mutually agreed upon in writing by the Parties. The Operator shall provide the Town with a splicing and splice testing schedule(s) so the Town’s representative may be present, subject to protocols of Rights-of-Way agreements. Splicing documentation (ATP and test results) will be provided by the Operator within ninety (90) days after splicing is completed. 8.3 The Town shall provide thirty (30) business days written notification to the Operator if a new splice point is needed after Acceptance of Additional Fiber. Approval of new splice points will be at the sole discretion of the Operator, and such approval shall not be unreasonably withheld. 8.4 All splicing will be performed by the fusion splicing method or by any other method that is mutually agreeable. All costs and expenses in connection with the foregoing splicing shall be borne by the Town.

SPLICING. Section 10.1 ToledoTel shall have the right to perform the physical splicing of any fiber owned by ToledoTel into the portion of the Fiber System within its IRU and to require that all physical splicing of fiber into the associated cable be performed as provided herein. Splicing can be performed at either designed end point(s) using a pigtail to bypass the cable (“End-Point Splicing”) or at a splice point that requires access to the cable (“Splice-Point Splicing”). In order to maintain the integrity of the Fiber System, ToledoTel or its contractors acting under ToledoTel’s direction must perform all End-Point Splicing and all Splice-Point Splicing anywhere on the Fiber System. For any portion of the Fiber System that is leased to an entity other than ToledoTel, ToledoTel may charge the entity requesting the splicing a comparable rate to the one it charges when splicing into fiber owned by the Lewis County PUD District No. Section 10.2 ToledoTel shall have the right to perform End-Point Splicing, and Splice-Point Splicing on the Fibers within its IRU at any time. Such request shall be given (with sufficient detail and specifications to enable performance of the splicing) not less than ten days prior to the date on which the Splicing be performed. Section 10.3 ToledoTel or its contractor performing any splicing shall obtain any and all permits necessary for the splicing. All splicing shall be performed by the splicing methods herein or by any other method that is mutually agreed by the parties in writing.
